Your Committee on Public Works to which was referred Communication
No . 1579 and Resolution No . 438-88 , reports as follows:
The purpose of Resolution No . 438-88 is to approve the lease between
the County of Hawaii and W. H. Shipman, Ltd . , for the lease of the
property designated as TMK : 1-6-03 :65 , Third Division, Keaau, Puna,
Hawaii for use as a transfer station. The resolution also specifies
that sufficient funds be budgeted for future fiscal years to pay the
rent .
Communication No . 1579 is a letter from the Chief Engineer
transmitting Resolution No. 438-88 and explaining that action on the
30-year lease had been delayed because of misunderstandings on the
part of the Department of Public Works and W. H. Shipman but the
misunderstandings have been corrected and the Department wishes to
execute the lease .
Resolution 438-88 is in error in its statement in item 1 that lease
agreement is between the County of Hawaii and the Trustees of the
Estate of Bernice Pauahi Bishop. Resolution 438-88 Draft 2 handed
out at the Committee meetings correctly states that the agreement is
between the County and W. H . Shipman, Ltd .
The lease attached to Resolution 428-88 as Exhibit A also had minor
errors in items b and m of the lessee ' s covenants . Item b specified
that the premises shall be used only as a rubbish dump. Item m
required the lessee to construct a gate on the main entrance to the
rubbish dump. Resolution 438-88 Draft 2, Exhibit A corrects these
items by specifying that the premises shall be used only as transfer
station and by deleting the requirement for constructing a gate .
Your Committee understands the following conditions of the agreement :
1 . The term of the lease is 30 years;
2 . The term of the lease started on April 22 , 1983 ;
3. The rent is one dollar per year; and
4 . The County shall comply with all applicable laws ,
ordinances and rules and regulations; and
5 . That the County shall take reasonable precautions to
protect any Chinese Banyan trees on the premises .

Your Committee on Public Works is in accord with the purpose of
Resolution No. 438-88 Draft 2 and recommends its adoption by the
County Council .
