AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 5, SECTION 24-281 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO PARKING. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The purpose of this measure is to update the Hawaii County Code to match the conditions that exist in the field. The subject area of Wilson Street between Kilauea Avenue and Derby Lane is too narrow for parking on both sides of the road. The southeast side is currently signed as a no parking at anytime zone. The northwest side is open to parking from just after 5:00 a.m. up to 10:00 p.m. SECTION 2. Chapter 24, Article 10, Division 5, Section 24-281, Schedule 29. Parking prohibited during certain hours on certain streets, subsection (c), South Hilo, of the Hawai`i County Code 1983 (2005 Edition, as amended), is amended by deleting existing item and renumbering the subsequent items: [{29) Wilson Street, except for northwest side, between Kilauea Avenue and Derby Lane, from 7:00 p.m. to 7:00 a.m.] SECTION 3. The purpose of this measure is to update the Hawaii County Code to match the conditions that exist in the field. The subject area along Derby Lane between Wilson Street and Hoku Street is too narrow for parking on both sides of the road. The southwest side is currently signed as a no parking at anytime zone. The northeast side open to parking from just after 7:00 a.m. up to 7:00 p.m. SECTION 4. Chapter 24, Article 10, Division 5, Section 24-281, Schedule 29. Parking prohibited during certain hours on certain streets, subsection (c), South Hilo, of the Hawai`i County Code 1983 (2005 Edition, as amended), is amended by adding new item and renumbering as required: ( ) Derby Lane, northeast side, from a point twenty-seven feet northwest of Wilson Street to a point forty-two feet southeast of Ho ku Street, from 7:00 p.m. to 7:00 a.m. SECTION 5. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 6. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 7. This ordinance shall take effect upon its approval.
