Your Committee on Public Works to which was referred Communication
No . 1162 and its attached Bill No. 380 , and Comm. 1162.1 and its
attached Bill No . 380 Draft 2 , reports as follows :
Bill 380 proposes to amend Chapter 2, Article 9 , Division 1 ,
Section 2-41; Chapter 20 , Article 1 , Section 20-8; Chapter 21,
Article 1 , Section 21-2; and Chapter 21 , Article 4 , Section 21-34 of
the Hawaii County Code 1983 relating to divisions within the
Department of Public Works . Bill 380 Draft 2 amends the sections of
the Hawaii County Code listed above and additionally amends
Chapter 17, Article 6 , Sections 17-72 and 17-73 , relating to
plumbing . The purpose of Bill 380 and Bill 380 Draft 2 is to divide
the responsibilities of the Waste Management Division into two
separate divisions, namely, the Solid Waste Division and the
Wastewater Division . Draft 2 of Bill 380 includes all of Bill 380
plus amendments to Chapter 17 , Article 6 , Sections 17-72 and 17-73 of
the Hawaii County Code 1983 .
Your Committee on Public Works has reviewed Bill 380 and 380 Draft 2
and understands that Bill 380 Draft 2 changes all the references to
the Waste Management Division, the Division of Sewers and the
Division of Sewers and Sanitation in the County Code 1983 to the
appropriate new name, either Solid Waste Division or Wastewater
Division .
Bill 380 and Bill 380 Draft 2 both add definitions of Wastewater
Division and Solid Waste Division to Chapter 2, Article 9 ,
Division 1, Sections 2-41 (a ) . The Wastewater Division as defined in
Section 2-41 (a) ( 5 ) specifies that the new division "shall be
responsible for the construction, maintenance and operation of all
sewage programs and facilities operated by and for the County. " The
Solid Waste Division as defined in Section 2-41 (a ) ( 6 ) "shall be
responsible for the construction, maintenance , and operation of all
solid waste facilities operated by and for the County. "
Bill 380 Draft 2 also uses the Ramseyer format in the standard way in
Section 2-47 (a ) ( 5) , specifically, placing the words to be deleted
before the words to be added .

Your Committee heard the Chief Engineer testify that the bill is
needed as a first step in creating a separate Solid Waste Division
which will be directly accountable to the Chief Engineer , thus making
control and administration easier . This would be the start of a
five-year management plan which calls for self-contained operation
for the Solid Waste Division , which ultimately would not rely for
manpower on the Highway Maintenance Division or other divisions .
Eighteen people presently staff the solid waste operation .
In response to a Committee member 's question on the cost impact of
the proposed reorganization , the Chief Engineer testified that no
additional cost or manpower requirements would result before FY 1989 .
Your Committee on Public Works recommends passage of Bill No . 380
Draft 2 on first reading by the County Cr s il .
