Your Committee on Public Works to which was referred Communication
No . 1106 and '1106 .1 with its attached resolution 358-87 , reports as
follows:
Communication 1106 transmitted for Council review and consideration ,
a dedication deed to the County of Hawaii for a portion of roadway
within the Henry Pascale Subdivision , Waikoloa , S. Kohala, Hawaii ,
TMK : 6-8-04 : 5 , 8 , 9 and 10 and a warranty deed to Henry Pascale from
the County of Hawaii for a portion of Lua Kula Place , excess to the
needs of the County of Hawaii .
Communication 1106 .1 transmits Resolution 358-87 to the County
Council which authorizes the sale of that parcel declared remnant by
Resolution 185-87 and located at Lua Kula Place in Waikoloa Village ,
South Kohala, Hawaii to Mr . Henry Pascale for a price of $5 , 143 .00 by
the County Director of Finance .
Your Committee on Public Works finds that County property at the end
of Lua Kula Place in Waikoloa Village , South Kohala , Hawaii , which is
more particularly described as EXHIBIT "A" of Resolution 358-87 , has
been declared to be a remnant parcel by Resolution 185-87 of the
Hawaii County Council .
Pursuant to the provisions of section 2-118 of the Hawaii County
Code , your Committee finds that any remnant parcel on portion thereof
considered for disposal shall first be offered for sale to the
abutting owner for a reasonable period of time and at a reasonable
price based on the appraised value of the property . Your Committee
further finds that the remnant parcel described in Resolution 358-87
has 'been appraised at $5 ,143 .00 by E. H. Araujo , Inc . , and that all
the land abutting this remnant parcel is owned by Mr . Henry Pascale .
Finally, your Committee has been advised and finds that Mr . Pascale
is ready , willing and able to purchase said remnant at its appraised
value .

Your Committee on Public Works recommends the adoption of Resolution
358-87 authorizing the sale of that remnant parcel located at
Lua Kula Place in Waikoloa Village , South Kohala, Hawaii for a price
of $5 , 143 .00 to Mr . Henry Pascale and that the arranty deed be
executed upon receipt of consideration .
