Your Committee on Public Works to which was referred Resolution
No . 363-87 , reports as follows:
The purpose of Resolution No . 363-87 is to authorize the chief
engineer to grant a perpetual and non-exclusive easement over that
County property being a 30-foot wide road and utility area , over and
across Parcel 5 of the Kainaliu Diversion System to Lucille Chang
Lum, Mitsusuke Nakamura and Yemiko Nakamura , Matthew Chow and Ann Yin
Tai Chow, Hazel N. Thomas , Barbara Yonamine , Kay Kunio Ota and Kiyoko
Ota , and Fred C . Oshiro and Violet E. Oshiro, herein referred to as
the "Grantees" for a consideration of less than $1 ,000 .00 by direct
negotiation and without recourse to public auction .
Your Committee finds that the "Grantees" have requested that the
County grant to them a perpetual and non-exclusive easement so that a
ford may be constructed providing an access to their property . Your
Committee is especially concerned as this easement and ford runs
through a Flood Diversion Channel and recommends that provisions
protecting the county from liability be included as part of the
easement grant .
Pursuant to Section 2-111 (a ) (2) of the Hawaii County Code 1983 , the
Council may , by resolution approved by a majority of its members ,
direct the finance director or chief engineer to grant easements of
County property for particular purposes , subject to reverter to the
County upon termination or abandonment of the specific purposes for
which it was granted , by direct negotiation and without recourse to
public auction when the sale price of such easement is less than
$1000 .00 .
Your Committee on Public Works is in accord with the purpose of
Resolution No . 363-87 , and provided that the -asement grant contains
provisions for protecting th ounty fr .m-liab ity, recommends the
adoption of Resolution No . 6 -87 y f- - nt Council .
