Your Committee on Public Works to which was referred Bill No. 333 ,
reports as follows:
The purpose of Bill 333 is to encourage landowners to voluntarily
create and designate handicapped parking stalls on private property
and to authorize the Hawaii County Police Department to enforce
handicapped parking privileges on private property where property
owners have specifically designated stalls for handicapped parking .
The Police Department currently has the authority to enforce
handicapped parking privileges on public property under the
jurisdiction of the County of Hawaii .
Your Committee on Public Works finds that Bill 333 did pass on first
reading on March 4 , 1987 and was referred back to Committee for
further review. Your Committee subsequently noted the existence of
technical drafting errors in Bill 333 and referred it back to the
Corporation Counsel for amendment .
First, Bill 333 , Draft 2 reflects amendments which correct references
to "Chapter 24 , Article 9" to read "Chapter 24 , Article 8" . The
incorrect references were found in the title, Section 2 and Section 3
of Bill 333 . Finally, Bill 333 , Draft 2 reflects amendments to the
most current language of Section 24-245 , Hawaii County Code 1983 .
Discussions during the Committee meeting revolved around two
concerns . First was the concern of the Corporation Counsel of a need
for an expansion of the proposed language "and such private property
as included herein ." as found in Section 1 of the bill . Your
Committee directed the Corporation Counsel to prepare amendatory
language correcting this shortcoming in time for the bill ' s second
and 'final reading by the County Council .
The second concern was one of retroactivity . Your Committee,
recognizing that the purpose of this measure is to encourage the
designation of handicapped parking stalls rather than mandate
compliance, did not see fit to provide for retroactivity .

Your Committee on Public Works, recommends that Bill 333 be filed and
Bill 333 , Draft 2 which corrects drafting errors, be passed on final
reading by the County Council .
