Your Committee on Public Works to which was referred Communication
No . 1186 and 1186 . 1 reports as follows:
Communication 1186 from Parks and Recreation Director Engelhard
recommends the acknowledgement of a contribution to the County of
Hawaii from Gentry Sports and the issuance of user fee credits
totaling $1, 197 .03 .
Communication No . 1186 .1 further advises that the claim for user fee
credits from Gentry Sports is being adjusted to $732 . 16 . The
adjusted claim was a result of further discussions between the County
of Hawaii Kona Parks Maintenance Supervisor Mr . Greg Sano and
Mr . Dean Wise representing Gentry Sports which followed the
Department of Parks and Recreation 's initial evaluation of Gentry ' s
claim.
Your Committee has been advised that Gentry Sports, in preparation
for their Big Island Sports Festival at Kailua Park on February 13 ,
14 , and 15 , 1987 , did expend a considerable amount of manpower to
bring the baseball and soccer fields to their level of acceptance .
Your Committee has also been advised that by letter dated June 22 ,
1987 , Gentry Sports did initially submit invoices totaling $6 ,598 .83
and requested credit for their July 31 through August 2 , 1987 event .
Chapter 5 , Article 6 , (Section 15-54 through Section 15-60 ) of the
Hawaii County Code of 1983 provide for credit against user fees for
private improvements to Parks and Recreation facilities . Your
Committee has reviewed Sections 15-54 through 15-60 of the Hawaii
County Code and finds that while the Gentry Sports contribution meets
with, the overall intent of Article 6 , the tendered request for credit
is procedurally incorrect . Your Committee recognizes that it is
important that the Department of Parks and Recreation be given an
opportunity to review the description and costs of all proposed
improvements which are to be used for user fee credits beforehand and
not after the fact .
Article 13 , Section 13-12 of the Hawaii County Charter provide that
the County Council , on behalf of the County, may accept gifts of
. donations of money, securities, or other personal property of real
estate or any interest in real estate .

Your Committee finds that all persons and organizations desiring to
make private improvements to Parks and Recreation Facilities should
be made aware of the provisions of Chapter 15 , Article 6 of the
Hawaii County Code . In the instance of the Gentry Sports
application, your Committee on Public Works recognizes that the
County of Hawaii is under no obligation to authorize credit against
future user fees as the application of credit was after the fact .
However , recognizing that the availability of such a provision for
user fee credit was partially discussed during the coordination of
the Big Island Sports Festival with the Department of Parks and
Recreation, your Committee recommends that the Department of Parks
and Recreation be authorized to allow a partial credit in the amount
of $732 . 16 to Gentry Sports against future user fees at Kailua Park
and that the Council accept the donation pursuant to Section 13-12 of
the Hawaii County Charter .
