Your Committee on Public Works to which was referred Resolution
No . 332-87 , reports as follows:
The purpose of Resolution No . 332-87 is to authorize the Director of
Finance to grant a temporary easement over County property
(TMK: 7-8-005-22 ) to David A. Randall for the purpose of allowing
access to his adjacent property to enable construction of
Mr . Randall 's residence . This temporary easement shall not exceed
one year in duration and shall be granted for a price not to exceed
$1 ,000 .
Your Committee understands that Mr . David A. Randall desires to
construct his house and garage on property next to the Higashihara
park . Mr . Randall 's, property is very rocky and sloped . Mr . Randall
intends to build his house and garage on separate tiers or levels
because of the sloping terrain . Mr . Randall needs an easement
through the County property to proceed with the construction of his
house . Mr . Randall has provided the County with an insurance policy
covering liability for use of this easement . Your Committee finds
Mr . Randall 's request and actions to be reasonable .
Pursuant to section 2-111 of the Hawaii County Code , the Council may ,
by resolution adopted by a majority of its members , direct the
finance director or chief engineer to grant an easement for a
particular purpose . This section further provides that when the sale
of such easement is less than $1 ,000 , the easement may be granted by
direct negotiation without recourse to public auction .
Your Committee on Public Works is in accord with the purpose of
Resolution No . 332-87 and rec+mmends its ado. . on by the County
Council .
