Your Committee on Public Works to which was referred Communication
- o . 1190 and its attached Bill No. 392 , reports as follows:
Bill 392 proposes to give the Mayor of the County of Hawaii emergency
powers to waive the requirements of Chapters 5 , 9 , 11 , 17 and 25 of
the Hawaii County Code of 1983 to afford any person , partnership, or
corporation in the Puako-Wailea area that was affected by the
July 1 , 2, and 3 , 1987 brush fire an opportunity to rebuild damaged
structures or buildings without having to strictly comply with all
the requirements of Chapter 5 , 9 , 11 , 17 , and 25 of the Hawaii County
Code .
Your Committee on Public Works has reviewed Bill 392 and is in accord
with its purpose . Your Committee finds that pursuant to Section 3-12
of the Hawii County Charter , the Council may adopt emergency
ordinances to meet public emergencies affecting life , health , and
property . Your Committee concurs with the Mayor 's use of an
emergency ordinance to assist property owners in the Puako-Wailea
area who suffered damage as a result of the July brush fire . Your
Committee finds that an emergency ordinance may be adopted by one
reading of the Council and stands automatically repealed as of the
sixty-first day following its adoption .
Your Committee on Public Works recommend ado ion of Bill 392 by the
