Dear Chairman Yoshimoto and Council Members:
Re: Resolution Providing for the Acquistion of Private Properties by Eminent
Domain, being portions of Tax Map Key: (3) 8-1-09: 34 & 52 (Parcel 22), 33 &
49 (Parcel 23), 03, 50 & 51 (Parcel 24), 08 (Parcel 27) and 07 (Parcel 28), Situate
at Ka`awaloa, South Kona, County and State of Hawai`i, for the Development and
Construction of Mamalahoa Bypass Road, Job No. E-4163, and Napo`opo`o
Road/Mamalahoa Highway Improvements, Job No. E-4614
Transmitted herewith for Council's approval is a resolution authorizing the acquisition of
private properties by eminent domain for the Mamalahoa Bypass Road, Job No. E-4163, and
Napo`opo`o Road/Mamalahoa Highway Improvements, Job No. E-4614, situated at Ka`awaloa,
South Kona, County and State of Hawai`i, in accordance with Section 101-13, Hawai`i Revised
Statutes.
Due to the pressing need for acquisition of the five parcels of land to complete the
development and construction of the last phase of the Mamalahoa Highway Bypass Road from
south of the intersection of Mamalahoa Highway Bypass Road and Haleki`i Street to the
intersection of Napo`opo`o Road and Mamalahoa Highway Intersection, the Department of
Public Works is requesting that this eminent domain resolution be waived through committee
and placed on the full Council agenda at the earliest possible time.

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i,this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
