.... . <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> GF•Npd <br /> RESOLUTION NO. 233 13 <br /> RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOT B (15-FEET WIDE <br /> ADDITION TO AINAOLA DRIVE RIGHT-OF-WAY), BEING A PORTION OF LOT B-4-2 <br /> A PORTION OF LOT 1001-A, GRANT 10,965 TO MASATARO NAGATA, TAX MAP <br /> KEY: (3) 2-4-031:025 (POR.), SITUATED AT WAIAKEA HOMESTEADS, SECOND SERIES, <br /> WAIAKEA, DISTRICT OF SOUTH HILO, ISLAND OF HAWAII FROM EDWIN Y. <br /> NAGATA, TRUSTEE OF THE EDWIN Y. NAGATA REVOCABLE LIVING TRUST DATED <br /> OCTOBER 6, 2008. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, Edwin Y. Nagata, Trustee of the Edwin Y. Nagata Revocable Living Trust dated <br /> October 6, 2008 ("Nagata") is the owner of Road Lot B (15-feet wide addition to Ainaola Drive Right- <br /> of-Way), containing an area of 0.065 acre more or less, identified as a portion of Tax Map Key: (3) 2- <br /> 4-031:025 (por.), situate at Waiakea Homesteads, Second Series, Waiakea, District of South Hilo, <br /> Island of Hawai`i, as delineated on Exhibit"A" attached hereto; and <br /> WHEREAS, Condition F of Ordinance No. 09-149, required a 15-foot wide future road <br /> widening strip be subdivided and dedicated to the County; and <br /> WHEREAS, Nagata received final subdivision approval for the above referenced lot; and <br /> WHEREAS, Nagata is desirous of dedicating the above road widening lot to the County of <br /> Hawai`i for roadway purposes, and such dedication has been approved by the County of Hawai`i <br /> Department of Public Works, and received dedication approval from the Department of Water Supply, <br /> Planning Department and Department of Environmental Management; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter,provides that the <br /> council may accept gifts, which include the dedication of land, on behalf of the County of Hawai`i. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds <br /> the subject subdivision and any improvements thereon are in full compliance with the provisions of <br /> Chapter 23 of the Hawai`i County Code as certified and approved by all applicable agencies. <br />
