RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOT B (15-FEET WIDE
ADDITION TO AINAOLA DRIVE RIGHT-OF-WAY), BEING A PORTION OF LOT B-4-2
A PORTION OF LOT 1001-A, GRANT 10,965 TO MASATARO NAGATA, TAX MAP
KEY: (3) 2-4-031:025 (POR.), SITUATED AT WAIAKEA HOMESTEADS, SECOND SERIES,
WAIAKEA, DISTRICT OF SOUTH HILO, ISLAND OF HAWAII FROM EDWIN Y.
NAGATA, TRUSTEE OF THE EDWIN Y. NAGATA REVOCABLE LIVING TRUST DATED
OCTOBER 6, 2008.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, Edwin Y. Nagata, Trustee of the Edwin Y. Nagata Revocable Living Trust dated
October 6, 2008 ("Nagata") is the owner of Road Lot B (15-feet wide addition to Ainaola Drive Right-
of-Way), containing an area of 0.065 acre more or less, identified as a portion of Tax Map Key: (3) 2-
4-031:025 (por.), situate at Waiakea Homesteads, Second Series, Waiakea, District of South Hilo,
Island of Hawai`i, as delineated on Exhibit"A" attached hereto; and
WHEREAS, Condition F of Ordinance No. 09-149, required a 15-foot wide future road
widening strip be subdivided and dedicated to the County; and
WHEREAS, Nagata received final subdivision approval for the above referenced lot; and
WHEREAS, Nagata is desirous of dedicating the above road widening lot to the County of
Hawai`i for roadway purposes, and such dedication has been approved by the County of Hawai`i
Department of Public Works, and received dedication approval from the Department of Water Supply,
Planning Department and Department of Environmental Management; and
WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter,provides that the
council may accept gifts, which include the dedication of land, on behalf of the County of Hawai`i.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds
the subject subdivision and any improvements thereon are in full compliance with the provisions of
Chapter 23 of the Hawai`i County Code as certified and approved by all applicable agencies.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,
in accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, and Chapter 23 of the
Hawai`i County Code, that the County of Hawaii accepts the dedication of Road Lot B, (15-feet wide
addition to Ainaola Drive Right-of-Way), containing an area of 0.065 acre more or less, identified as a
portion of Tax Map Key: (3) 2-4-031:025 (por.), delineated on Exhibit"A" attached hereto, for public
road purposes.
BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor
William P. Kenoi; (2) the Department of Public Works; (3) Assistant Corporation Counsel Katherine
A. Garson; and (4) Nathan T. K. Aipa, Esq., Pitluck Kido & Aipa, LLP, 701 Bishop Street, Honolulu,
Hawai`i 96813.
