RESOLUTION NO. 234 13
RESOLUTION ACCEPTING THE DEDICATION OF LOT E OF KONA COMMONS
(MAKALAPUA BUSINESS CENTER SUBDIVISION INCREMENT 3) (FILE PLAN
2454), BEING A PORTION OF TAX MAP KEY: (3) 7-4-025:017, (MAKALA
BOULEVARD), AND THE SEWER SYSTEM THEREUNDER SITUATED AT
KEAHUOLU, DISTRICT OF NORTH KONA, ISLAND, COUNTY AND STATE OF
HAWAII FROM TRUSTEES OF THE QUEEN LILI`UOKALANI TRUST.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, Trustees of the Queen Lili`uokalani Trust are the owners of Lot E of Kona
Commons (Makalapua Business Center Subdivision Increment 3) (File Plan 2454), containing an
area of 3.336 acres, identified as a portion of Tax Map Key: (3) 7-4-025:017, (Makala
Boulevard) situated at Keahuolu, District of North Kona, Island, County and State of Hawai`i,
as delineated on Exhibit "A" attached; and
WHEREAS, Trustees of the Queen Lili`uokalani Trust are the owners of the sanitary
sewer system, including all sanitary sewer pipelines, equipment, and other related facilities and
appurtenances attached thereto (hereinafter"sewer facilities") installed and in existence on and
under the above referenced lot; and
WHEREAS, Trustees of the Queen Lili`uokalani Trust have constructed all subdivision
improvements and received final subdivision approval for the above-referenced lot; and
WHEREAS, Trustees of Queen Lili`uokalani Trust is desirous of granting the County of
Hawai`i the sewer facilities, which are found on the above referenced lot described in Exhibit
"A" attached; and
WHEREAS, the sewer facilities have been inspected and found to be in acceptable
condition and are in compliance with the provisions of Chapter 21 of the Hawai`i County Code;
and
WHEREAS, Trustees of the Queen Lili`uokalani Trust are desirous of dedicating the
above roadway lot and sewer facilities, including all subdivision improvements thereon, to the
County of Hawai`i for roadway and sewer purposes, and the improvements have been inspected
and approved by the County of Hawai`i Department of Public Works, and received dedication
approval from the Department of Water Supply, Planning Department and Department of
Environmental Management; and
WHEREAS, Section 23-10 of the Hawai`i County Code prohibits the Council from
receiving by dedication any streets in any subdivision platted after December 2, 1966 except
upon full compliance with the provisions of Chapter 23; and
WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that
the council may accept gifts, which include the dedication of land, on behalf of the County of
Hawaii.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it
finds the subject subdivision and improvements thereon are in full compliance with the
provisions of Chapter 23 of the Hawai`i County Code as certified and approved by all applicable
agencies.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that in
accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, and Chapter 21 of
the Hawai`i County Code, the County of Hawai`i finds that it is in the public interest to accept,
and hereby accepts, the sewer facilities found on the premises described in Exhibit "A" attached
hereto.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, and
Section 23-10 of the Hawai`i County Code, that the County of Hawai`i accepts the dedication of
Lot E (Makala Boulevard), containing an area of 3.336 acres, identified as a portion of Tax Map
Key: (3) 7-4-025:017, delineated on Exhibit "A" attached hereto, and hereby accepts the sewer
facilities, including all improvements thereon, for public roadway and drainage purposes.
BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to:
(1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) Assistant Corporation
Counsel Katherine A. Garson; and (4) Nathan T. K. Aipa, Esq., Pitluck Kido & Aipa, LLP, 701
