Bill 339 proposes to amend the provisions of Chapter 14 , Article 1 ,
of the Hawaii County Code 1983 by updating and clarifing this
County 's provisions relating to the consumption of alcoholic
beverages in its parks facilities . Bill 339 categorizes and lists
each park facility under one of four categories--Drinking prohibited
at all times , drinking permitted by permit between 6 a .m. and
12 midnight, drinking permitted between 6 p.m. and 12 midnight, and
drinking permitted between 6 a .m. and 12 midnight .
Your Committee on Public Works first considered Bill 339 at its
meeting of March 10 , 1987 . The Director of Parks and Recreation
opened the discussion by recommending a number of changes . Active
discussion by your Council Members resulted in other recommended
changes .
On March 23 , 1987 , your Committee on Public Works , continued its
review of Bill 339 . Bill 339 , Draft 2 , incorporating the recommended
changes from the Public Works meeting of March 10 , 1987 , was surfaced
for review. Bill 339 was amended in Committee to Bill 339 , Draft 2.
On March 30 , 1987 , your Committee held a public hearing in Hilo on
Bill 339 , Draft 2 . Four individuals presented testimony .
Mr . John Sosa, Hawaii Deputy District Superintendent, expressed the
Department of Education 's concern that the County of Hawaii continue
to prohibit drinking in park facilities adjacent to public schools .
Concerns regarding the consumption of alcoholic beverages till
midnight in neighborhood parks were raised by concerned citizens .
On April 1 , 1987 , your Committee conducted its second public hearing
on Bill 339 , Draft 2 , in Kailua-Kona . Six citizens provided pubic
testimonies . Generally , they expressed concerns with the Kailua Park ,
the Kahalua Beach Park , and the Magic Sands Beach Park .
Your Committee has also received a third draft of Bill 339 . This
bill , Bill 339 , Draft 3 , incorporates the public input of the Hilo
and Kona Public Hearings . The changes include:

1 . Reducing the hours when drinking is permitted in parks from
12 midnight to 10 p .m in most parks . The exception to this
rule is in parks where liquor consumption is allowed by
permit .
2 . Redefining the Waiakea Penninsula area .
3. Shifting parks as a result of public testimony and
discussions . Affected parks are Carvalho, Hualani ,
Mohouli , Pepeekeo and University Heights Park in the South
Hilo District ; Kailua Park in the North/South Kona
Districts ; Waipio Lookout in the North Hilo, Hamakua
District ; and Waikoloa Highway Park in the North/South
Kohala District .
4 . Non-substantive deletions and renumbering.
Your Committee has reviewed Bill 339 , Draft 3 and is in general
agreement with the proposed changes . Finally, your Committee has
amended Bill 339 , Draft 3 , by moving the Higashihara , Hillcrest , and
Kona Scenic Parks to the drinking prohibited section .
Your Committee on Public Works , having amended Bill 339 , Drafts 2 and
3, submits Bill 339 , Draft 4 to the Council for consideration and
passage on first reading .
