Chairman and Members Hawaii County Council Hilo , Hawaii 96720 Your Committee on Public Works to which was referred 'Communication No . 1106 , reports as follows: Communication 1106 transmits for the Council 's review and consideration , a dedication deed to the County of Hawaii for a roadway within the Henry Pascale Subdivision, Waikoloa, S. Kohala, Hawaii , TMK: 6-8-04 : 5 , 8 , 9 and 10 . Communication 1106 also transmits for the Council 's review and consideration , a warranty deed from the County of Hawaii to Henry Pascale for a portion of Lua-Kula Place which is in excess to the requirements of the County of Hawaii . Your Committee finds that Mr . Henry Pascale seeks to acquire a County-owned turnaround area situated at the end of a cul-de-sac on Lua-Kula Place in Waikoloa Village , Waikoloa , S . Kohala , Hawaii . Mr . Pascale was informed by officials of the Department of Public Works that , assuming a sale of the property could be made , a necessary condition precedent to such a sale was the dedication to the County of another suitable turnaround area , one effect of which is to render useless the old turnaround area and thereby making it susceptible to abandonment proceedings . The road dedication deed is for that new turnaround area . Your Committee has been advised that the Department of Public Works has checked the descriptions and found them to be acceptable and that the new turnaround area has been constructed according to County of Hawaii dedicable standards . Your Committee has also been advised that the subdivision has received recordation approval from the Planning Department . The dedication of this new turnaround area is the first of three steps which must be completed to allow Mr . Pascale to acquire that County-owned turnaround area . The second step requires that the County abandon the newly created remnant . Resolution 185-86 , also being considered, accomplishes this . The final step is the disposal of the remnant road parcel in accordance with the provisions of Section 2-118 and other provisions of the Hawaii County Code . The warranty deed transmitted with Communication 1106 is being provided by the developer to expedite this final step. • PWC REPORT ;';p , 161 ADOPTED: JUN 3 1987 ff r PWC-161 Page 2 May 26 , 1986 Your Committee on Public Works finds that the conveyance of the roadway and improvements to be proper and recommends acceptance of the dedication deed by the Council and its subsequent recordation with the Bureau of Conveyances . Your Committee also recommends that action on the Warranty Deed be deferred until the Departments of Public Works and Finance advise that the disposal of the newly created remnant is permissable under the provision of the Hawaii County Code . tt . i # i f ME' LE K.
