Your Committee on Public Works to which was referred 'Bill 362,
reports as follows:
The purpose of Bill 362 is to revive the provisions of Chapter 24 ,
Article 5 , Hawaii County Code 1983 relating to the inspection of
vehicles . These provisions are scheduled to be repealed on June 30 ,
1987 in accordance with Ordinance No . 86-133 . Bill 362 repeals
Ordinance No . 86-133 to accomplish this purpose .
your Committe on Public Works finds that at the County Council
Meeting of May 6 , 1987 , a letter from State Director of
Transportation 'Edward Hirata dated April 30 , 1987 , was received by
the Council announcing the formation of a task force to study the
Motor Vehicle Inspection Program. Goals of the task force include
reviewing the effectiveness of the inspection program, considering a
proposal which delegates both the rule making and fee setting
responsibilities to the Department of Transportation, and proposing
legislation , as required , for the 1988 State Legislature .
Your Committee on Public Works is supportive of the Department of
Transportation 's suggestion of forming a task force to study the
Motor Vehicle Inspection Program and is aware that any desired and
significant changes to the inspection program must be madated by the
State Legislature . Accordingly, your Committee suports an extension
of the June 30 , 1987 "sunset " date of Chapter 24 , Article 5 ,
Hawaii County Code 1983 to afford the task force sufficient time to
accomplish its purpose .
In reviewing this measure, your Committee finds that the effect of
( Bill 362 is to rescind Ordinance No . 86-133 which repeals the
provisions of Chapter 24 , Article 5 , Hawaii County Code 1983 relating
to the inspection of vehicles on June 30 , 1987 . Your Committee also
finds that the stated purpose of this bill is not consistent with the
effect of Bill 362. Your Committee has corrected this inconsistency
by amending Bill 362 and deleting the words "for a period of one year
only" from Section 1 . Your Committee recognizes that while
Bill 362 , Draft 2 , does not provide for a "sunset" of this County's
vehicle inspection provisions on June 30 , 1988 , another measure ,
Bill 364 , extending vehicle inspection fees until June 30 , 1988 , does .
