Your Committee on Public Works to which was referred Communication
No . 1052 , reports as follows:
Communication 1052 submits for the Council 's attention , the latest
rules of the State Department of Transportation which regulate the
periodic safety inspection of vehicles .
Your Committee is very much concerned about the state mandated
periodic vehicle safety inspection program. Your Committee recalls
past public inputs which questioned this program and Hawaii County
Resolution No . 220-86 which requested the Governor , the Fourteenth
State Legislature , and the State Department of Transportation to
insure that this program serves a justified and functional purpose.
It is this committee 's understanding and belief that while the Rules
of the Department of Transportation have been relaxed to more
acceptable standards as a result of public input , the program itself
has not been justified .
Your Committee is aware that the Council did by overiding the Mayor 's
veto , adopt "sunset" provisions for that portion of the County Code
relating to the inspection of vehicles . That "sunset" date is
June 30 , 1987 . Your Committee believes that the justification of the
periodic vehicle inspection is important and that there is still time
to determine its validity . Your Committee , therefore , recommends
that the Council of the County of Hawaii , direct the Corporation
Counsel to seek a declarator;ya judgment against the State of Hawaii
to determine the validity of the periodic vehicle inspection program.
