Subject : Referral of Bill No. 109, For Comments& Recommendations of the Director
Of the Department of Environmental Management and the Environmental
Management Commission
Pursuant to Section 2-207 of the Hawai'i County Code, we are responding to your request for
review and recommendation of the subject Bill.
At the October 30, 2013 meeting, the Environmental Management Commission voted
unanimously to provide a negative recommendation for Bill 109 from a practical and logistical
standpoint with regard to budget and staffing. In addition,the Bill does not fall naturally within
the scope and duties of the Department and there is an absence of clear enforcement
authority.
