y Your Committee on Public Works to which was referred Communication
No . 856 , reports as follows :
Communication 856 from Mr . Rodney R. Shinkawa , Executive Vice
President/Treasurer of First Federal Savings , is a request for a
sign variance for a 66 square foot illuminated roof sign over the
First Federal Savings Office at the Prince Kuhio Shopping Plaza .
Your Committee has reviewed the written testimonies of both the
Department of Public Works and the Department of Planning. Your
Committee finds that the maximum allowable roof sign in a
commercially zoned district is 32 square feet . Your Committee is
aware that the adjacent establishments, Safeway and Longs , both have
been granted variances for non-conforming roof signs .
Pursuant to Chapter 3 , Article 1 , Section 3-5 , Hawaii County Code,
the Council may grant a variance to an applicant for a sign permit
when the Council finds that the enforcement of the provision would
work a hardship upon the applicant , and that the granting of a
variance would not be contrary to the spirit and purpose of this
article and the public interest .
During Committee discussion Councilman Herkes expressed his dismay
with granting a sign variance as requested. Your Committee has not
received any significant testimony demonstrating a hardship upon the
applicant . However your committee has not received any testimony
showing that the granting of variance is contrary to the spirit and
purpose of this sign ordinance . As such your Committee recommends
that this request by First Federal Savings for a ign variances be
granted .
