Your Committee on Public Works to which was referred 'Communication
916 reports as follows :
Communication 916 is a transmittal letter from Patricia Engelhard,
Director of the Department of Parks and Recreation , which requests
formal acceptance of a motocross facility located at the County drag
strip donated by Mr . Kenneth King of Suzuki of Hilo . The motocross
facility was constructed by Suzuki of Hilo, Willocks Construction
and other members of the public .
Chapter 15 , Article 6 , Section 15-55 , Hawaii County Code , provides
that private citizens or civic groups , after donating a completed
improvement to the County for the use and benefit of the general
public , may receive a credit against user fees imposed by the
Department of Parks and Recreation for the use of the facility at
which the improvements were made .
Your Committee finds that the Parks and Recreation Director Patricia
Engelhard has received a request from Kenneth King , owner of Suzuki
of Hilo, for a $12 ,000 credit against user fees for the use of the
motorcross facility . Ms . Engelhard concurs that improvements made
amount to at least $12 ,000 and is in agreement with this request for
a user fee credit . The fee for the use of the facility is $100 per
day. The $12 ,000 credit would be good for 120 days of usage , and
such credit shall be good for no longer than twenty years after the
date the improvement is accepted by the County.
Chapter 15 , Article 6 , Section 15-58, Hawaii County Code , further
provides that improvements must be offered for dedication to the
County before allowing any credit against user fees . As such ,
Communication 916 requests acceptance of the improvements .
Pursuant to Section 13-12, Hawaii County Charter , the County
Council, on behalf of the County, may accept gifts of donations of
money, securities , or other personal property or of real estate or
any interest in real estate .

Your Committee on Public Works recommends that the Hawaii County
Council accept the improvements made to the motocross facility at
the Hilo Drag Strip and concurs with the granting of a user fee
credit to Mr . Kenneth King, for the amount of $12,000 .
