Your Committee on Public Works to which was referred Bill 300,
reports as follows :
Bill 300 proposes to establish County-wide regulations relating to
use of sidewalks and to transfer the authority for issuing sidewalk
use permits from the Council to the Chief Engineer . Bill 300
deletes the requirement for a statement of consent from an abutting
property owner or occupier when an applicant for a newsstand, news
rack or other similar publications dispenser desires to utilize a
sidewalk area. Bill 300 also clarifies the fee structure for
sidewalk permits and provides for an implementation date of July 1 ,
1987 .
Your Committee on Public Works reviewed Bill 300 at its meeting of
January 13 , 1987 and recommended its adoption on first reading by
the County Council . Your Committee also recommended that Bill 300
be referred back to the Committee on Public Works prior to its
consideration on final reading.
Your Committee has taken this additional time to review Bill 300.
Your Committee finds shortcommings in two areas . First , Bill 300
proposes to delete the present requirement for a statement of
consent from the abutting property owners and occupiers for the use
of a sidewalk area. As the County does place a responsibility to
maintain a sidewalk in proper repair on its abutting property owner,
that property owner should have some say as to what is placed on the
sidewalk. Accordingly, the statement of consent from abutting
property owners should be maintained.
Second, your Committee finds it conceivable that an applicant may
request the use of more than one sidewalk area and thus recommends
that references to "sidewalk area desired" be pluralized to read
"desired sidewalk areas" .

Your Committee on Public Works, having amended Bill 300 to require a
statement of consent from the abutting property owner and by
pluralizing references to sidewalk areas, submits and recommends
Bill 300 Draft 2 to the County Council for passage on final reading .
