Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Public Works to which was referred Communication 683 and its attached Bill 222 , reports as follows . The purpose of Bill 222 is the creation of an additional revenue source to the County by authorizing the sale of space for commercial advertising in County Park areas . Your Committee on Public Works did , on July 29 , 1986 , have an opportunity to review Bill 222. The bill permits the moderation of existing restrictions on commercial notices or advertising in park areas and will enable the County to allow private firms to advertise their products in County parks . During this review, your Committee recommended Bill 222 be amended to include a purpose section and referred Bill 222 back to the Department of Parks and Recreation . Bill 222, Draft 2, represents that amended Bill . In addition Bill 222, Draft 2, also provides that the Director of Parks and Recreation shall promulgate rules pursuant to Chapter 91 , Hawaii Revised Statutes for the regulation of advertising in parks . Your Committee had a very active discussion on the proposed bill . Several of its members expressed some reservation about authorizing the promulgation of rules and regulations to govern advertising without knowing the direction of the department of park and recreation . There were also concerns that allowable advertising be consistent with our County sign ordinance and advertising on County busses , and that an estimate of the proposed revenues was unavailable . Director of Parks and Recreation Patricia Engelhard, in commenting on the application of the proposed ordinance , did suggest as an example , that revenues from the sale of advertising space on our Municipal Golf Course scorecards could offset its estimated $3000 to $4000 per year printing cost . Director Engelhard also advised that if during the rule making public hearing process , strong testimony against advertising or billboards on park fences were to be presented, she would be pressed into adopting rules conforming to public sentiment. PWC REPORT No . 117 ADOPTED : NOV 3 196 a s PWC-117 Page 2 October 21 , 1986 Councilman Herkes expressed his strong opposition to the proposed ordinance as the measure could allow the erection of both permanent and temporary signs around our parks and ballfields . He was particularly concerned as prior testimony received against advertising in parks was not readily available during this deliberation . His opposition is to active and conspicuous public displays of advertising, and not to a more specific and personalized application such as on a golf scorecard . Your Committee on Public Works recommends that Bill 222 be amended to reflect a purpose section and to authorize the director of parks and recreation to adopt rules for the purposes of allowing advertising in parks . Your Committee further recommends by a vote of 4 Ayes and 1 No (Mr . Herkes ) that this amended bill (Bill 222, Draft 2 ) be adopted by the Council on first reading and referred back to the Committee on Public Works prio to its final reading. RLE K. LAI, CH .
