Your Committee on Public Works, to which was referred
Communication 737 and its attached Bill 239, reports as follows :
The purpose of Bill 239 is to amend the provisions of Chapter 22 of
the Hawaii County Code 1983 relating to streets and sidewalks and
their maintenance. First, Bill 239 simplifies the notification
process with respect to the removal of obstructions and
encroachments . Bill 239 also proposes provisions authorizing the
removal of encroachments by the Department of Public Works when an
encroachment constitutes a hazard to public safety and welfare and
requires immediate removal . Finally, Bill 239 proposes punitive
measures for the failure of a landowner to maintain his/her abutting
sidewalks .
Your Committee on Public Works is in accord with the purpose of
Bill 239 and recommends its passage on first reading by the County
Council.
