Your Committee on Public Works, to which was referred Bill 225,
reports as follows:
The purpose of Bill 225 is to correct a deficiency in the
Hawaii County Code 1983 which limited the penalty provisions to
violations of Article 1 of Chapter 15 on Parks and Recreation.
Under the former County Code, the provisions for County parks and
recreation areas, including the penalty for violations thereof, were
all contained under a single article. Bill 225 , in correcting this
1983 codification error reinforces this Committee 's position against
the destruction, misuse and abuse of County facilities .
In its review of Bill 225, the Committee on Public Works has noted
some inconsistency in the proposed penalty provisions of the
County Code with respect to destruction of public property within
recreational areas and believes that penalties for all property
offenses should be of equal severity. Accordingly, your Committee
has amended Section 2 of Bill 225 increasing the maximum pecuniary
penalty from p500 to X1 , 000 and imprisonment from sixty days to
maximum of not to exceed ninety days . Your Committee has also added
the provision that in addition to the penalties, the County may
recover for damages to its property, the measure of which shall be
the cost of repairing, replacing or rebuilding the property injured
or destroyed .

Your Committee on Public Works is in accord with the purpose of
Bill 225 to correct the 1983 codification error . Your Committee on
Public Works has also revised the penalty provisions of Chapter 15 ,
Hawaii County Code 1983 , be consistent with the penalties for
property offenses as proposed for Chapter 14. Your Committee on
Public Works recommends the passage of Bill 225 as amended on first
reading by the County Council.
