Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Public Works , to which was referred Bill 168 , reports as follows: The purpose of Bill 168 is to amend Chapter 22, Article 1 , Division 5 , Sections 22-21, 22-24 , and 22-25 of the Hawaii County Code 1983 by amending its provisions which regulate the use of sidewalks within the city limits of Hilo to permit cafe table services on public sidewalks . Bill 168 also expands the prior seven-day permit period applicable to merchandise sales on sidewalks to one year . Bill 168 passed first reading on May 7 , 1986 and was referred back to the Committee on Public Works . Your Committee is supportive of the purpose of Bill 168 as a means of assisting in the revitalization of the business climate in downtown Hilo . It is concerned, however , about the use of public property for private commercial activities . Recognizing the costs involved in administering these provisions , your Committee is considering the possibilitity of assessing businesses for use of County property and requests that the Corporation Counsel make a determination as to the County 's ability to impose such a fee . The Public Works Committee Chairperson will be meeting with the Corporation Counsel to discuss the Committee 's concerns and his findings . During Committee discussions considering the assessment of a fee for use of public property , concern was expressed regarding the applicability of such a fee to sidewalk sales and other short term commercial activities. Committee members contemplated separating the provisions relating to cafe table activities from provisons relating to sidewalk sale activities in order to exclude these activities from any asessment . 87 PWC REPORT NO ADOPTED : JUN 4 1986 V A PWC- Page 2 May 27 , 1986 Your Committee on Public Works concurs with the purpose of Bill 168 and recommends its passage on second reading pending the Chairperson 's discussions with the Corporation Counsel regarding the County 's ability to assess private entities fo the use of public property for commercial purposes . 4(442, JP' ME: E K.
