Your Committee on Public Works , to which was referred Bill 79 ,
relating to the animal control ordinance , reports as follows .
The purpose of Bill 79 is basically to modernize the County Code
relating to animal control . First , in the area of penalties ,
Bill 79 proposes to give our judges some discretionary powers by
changing the penality for a violation from "$10" to "not more
than $50" . Second, Bill 79 establishes an enforcement section with
procedures in line with current practice and the City and County of
Honolulu 's Code . Third, Bill 79 proposes provisions whereby all
fines and forfeitures collected for violations of the ordinance be
paid to the general fund of the County of Hawaii . Finally, Bill 79
prohibits the taking of any dog , cat or other domestic animal on or
about any County beach park or place of business where food or food
products as sold or displayed .
Your Committee on Public Works in discussing Bill 79 at its meeting
of September 24 , 1985 found that further clarification was required
to Section 4-29 of the County Code as the provisions appeared to be
a conflict with the intent of prohibiting dogs , cats or other
domestic animals from County Beach Parks and places where food or
food products are sold or displayed . Your Committee , also accepted
the recommendation from the Humane Society that the penalty for
cruelty to animals be increased to not more than $500 .
The Committee requested that Jay Kimura, Deputy Prosecuting
Attorney, provide information as to whether State prohibits dogs ,
cats , or other domestic animals in their parks .

Your Committee on Public Works has amended Bill 79 by clarifying
Section 4-29 of the County Code to be consistent with the purposes
of the Bill . Further , the Committee has amended Bill 79 by
providing for a $500 maximum fine for violations of cruelty to
animals . Your Committee on Public Works, having adopted these
amendments , submits Bill 79 (Draft 2 ) to the County Council for
passage on first and second readings .
