your Committee on Public Works, to which was referred
Communications 131 , 131 .1 and Resolution 57-85 relating to the
creation of an Improvement District for the Keaau Agricultural Lots
Subdivision, reports as follows:
Communication 131 is a transmittal letter which introduces to the
Public Works Committee a petition for the creation of an Improvement
District (Keaau Agricultural Lots Subdivision) and its accompanying
transmittal letter . The petition requests that the County Council
review and approve the proposed Improvement District which will be
used to finance improvements that include dedicable roads , water ,
electrical and street lighting systems . The petition proposes that
all of the costs of the improvements would be assessed to the lots
of the subdivision and that none of the costs be borne by the County.
Communication 131 .1 is the Preliminary Report of the Chief Engineer
of the County of Hawaii on the proposed Improvement District
Petition. It is submitted in accordance with Resolution 50-85 and
Section 12-10 of the Hawaii County Code. The Preliminary Report
does summarize that the petition conforms to the applicable sections
of our County provisions on improvements by assessment and
recommends Council ratification.
Resolution 57-85 proposes that the Council accept and adopt the
petition for the creation of an improvement district and the
Preliminary Report of the Chief Engineer . Resolution 57-85 also
proposes the creation and definition of " Improvement District 16-
Keaau Agricultural Lots" and directs the Chief Engineer to prepare a
final report for the proposed improvements in accordance with
Chapter 12, Hawaii County Code.
Your Committee finds that both the petition and the preliminary
report of the Chief Engineer to be proper . Your Committee accepts
the Preliminary Report recommendation of the Chief Engineer that
Exhibit IV-3 of the petition be amended to show a $200,000
contingency and that the roadway cost estimate be reduced by the
same amount . These amendments are reflected in Resolution 57-85 .

Your Committee on Public Works is in agreement with the purpose and
intent of Resolution 57-85 and recommends its adoption by the
Council of the County of Hawaii .
