Your Committee on Public Works, to which was referred
Communication 166 , reports as follows:
Communication 166 is a request for a permit to display and sell
merchandise on the sidewalks of Hilo on June 21 and June 22, 1985 ,
as part of a sidewalk sale to be held in conjunction with their
annual International Festival of the Pacific festivities which is
sponsored by the Japanese Chamber of Commerce and Industry of
Hawaii . Also submitted with this request is the consent and
approval of the Downtown Improvement Association which asserts it
representation of the owners or lessees of the lands directly
abutting the sidewalk area desired to be used for the public
sidewalk sale of goods .
Your Committee recognizes that the sidewalk sales has long been a
major part of the International Festival . Your Committee recommends
that the Council grant a permit for a sidewalk sale in the City of
Hilo on June 21 and June 22, 1985 to the Japanese Chamber of
Commerce, provided, however , that properties or services offered for
sale by the holder of the permit or its agents shall not cover more
than two-thirds of the width of the sidewalk and will not exceed a
height of four feet. Your Committee further recommends that the
holder of the permit be required to indemnify and save harmless the
County, the officers and agents thereof, from all claims , demands ,
suits, actions or proceedings of every name, character and
description which may be brought against the County for or on
. account of any injuries or damages to any person or property
received or sustained by any person by or in consequence of any act
or acts of the holder of the permit for act]. s done under the
permit .
