Your Committee on Public Works, to which was referred
'Communication 1721 relating to Rules and Regulations of the
Department of Parks and Recreation, reports as follows:
Communication 1721 is a transmittal letter which submits to the
County Council pursuant to Section 13-7 of the Hawaii County Charter
Rule 8 of the Rules and Regulations of Department of Parks and
Recreation for ratification . Rule 8 is a new rule which delineates
departmental scope and provides for the use of and conduct at public
facilities under its control .
Included in Rule 8 are (1 ) Rules Relating to the Director 's
Authority to Prohibit Use; ( 2 ) Rules Regulating Conduct in Park
Facilities ; ( 3) Rules Relating to the Operation and Parking of
Vehicles; ( 4 ) Rules Applicable to Persons having Exclusive Use of
Parks Facilities; ( 5) Rules Relating to the Use of Waiakea
Recreation Center Hostel Unit ; ( 6 ) Rules on Co-sponsored Activities;
and (7) Rules Relating to Beach Parks .
Specific provisions of note , includes an established speed limit
within parks of 10 miles per hour ; closing of parks to people and
vehicles (except by permit ) between 12 :00 midnight to 6 :00 a .m. ; and
requiring as a condition of exclusive use of a park facility,
indemnification of the County against any and all damages , claims ,
actions , demands or proceedings for property damages , personal
inquiry or wrongful death arising out of , resulting from, or
connected with the exclusive use of the park facility.
Communication 1721 advises that public hearings on the proposed
rules were held on August 7 and 8 , 1985 , in Hilo and Kailua
respectively. The Department of Parks and Recreation submits that
Rule 8 is necessary for the regulation of public facilities that are
not covered by existing rules . The Department submits that Rule 8
is in the best interest of the County and submits it for adoption .

Your Committee finds that Rule 8 of the Department of Parks and
Recreation has been duly promulgated. Your Committee recommends
adoption of Rule 8 by the County Council .
