BILL NO. 167
AN ORDINANCE AMENDING CHAPTER 25, ARTICLE 4, DIVISION 3 OF THE HAWAII
COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO THE MAXIMUM
AMOUNT OF LOTS PERMITTED INA SUBDIVISION.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 25, article 4 , division 3 of the Hawaii County Code 1983 (2005
Edition, as amended), is amended by amending its title to read as follows:
"Division 3. Street Frontage, Lot Areas, Amount of Lots, and Widths.
SECTION 2. Chapter 25, article 4, division 3 of the Hawaii County Code 1983 (2005 Edition,
as amended), is amended by adding a new section to be appropriately designated and to read as follows:
Section 25-4- . Maximum amount of lots in a subdivision.
(a) In determining the maximum amount of lots permitted in a subdivision approved by
the director under chapter 23 of this Code, the square footage of the following
improvements and features shall be subtracted from the total land size of the
subdivision:
(1) Required streets, sidewalks, and gutters, including all parking and loading
zones;
(2) Landscaping for the streets;
(3) Setbacks for future road widening;
(4) Open space, green belts, and endangered species habitat,
(5) Required parks and sites for community building(s); and
(6) One -hundred year floodplain(, drainage ditches, drywells (if not located in
the street), and pondingareas.
bb) After reductions are applied pursuant to subsection (a), the maximum amount of
lots permitted in a subdivision shall be determined pursuant to the provisions of the
applicable district classification, or district classifications, as the case may be, as
provided in this chapter. If the figure that represents the maximum amount of lots
permitted in a subdivision is not a whole number, that figure shall be rounded down
to the nearest whole number."
SECTION 3. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed and stricken material and
underscoring need not be included.
SECTION 4. Severability. If any provision of this ordinance, or the application thereof
to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
