The writer has just returned from out of state and find that you are holding a public hearing at the councilroom today, and submits herewith the following, as a matter of record,concerning our position to two specific issues as con- tained on page 14, item f, and page 23 , regarding: A) deletion of the secondary road circulating Kuhio Village; P) deletion of Route 19 Mud Lane: 1) Our letter of June 17 , 1981 , to T Iaimea-Kawaihae Community Association, with petitions attached, opposing A) above, in support of Councilman Schutte' s letter of June 9, 1981 , stating that this circulating road will be deleted; 2) Our letter of June 5, 1981 to Ceorgiana Padeken, expressing_ our opposition to the above; 3) Letter of June 9, 1981 , from Dr. A. L. Solomon, Hawaii OHA Trustee, in support of our position; 4) Our letters of June 15, 1981 , to Georgiana Padeken and Mr. Alvah Miyamoto, re-stating our position; 5) Letter dated June 14, 1981 , from the Keaukaha Panaewa Farmers ' Association supporting our stance; for your consideration and action requesting its deletion from the Waimea Design Plan as contained on pages 14 and 23. Box 1090 Kamuela, HI 96743 Board of Directors: June 17 , 1981 Pres: Ethel Andrade Vice Pres: Martina Whitehead Sec: Kloh-Anne Drummondo Cor/Sec: Rhonda Anduha Treas: Clarence Kauahi Membership: Jane Asing T Taimea-Kawaihae Community Association Meeting June 17 , 1981 Mr. Chairman, For the record, we oppose the proposed Hawaii Belt 'load, Route 19 Mud Lane , as indicated on page 23 , based on the fact that: 1) our Homesteaders questioned its legality on December 6, 1976, again on October 17 , 1977 , followed by a presentation of petitions which included the Lakeland residents affected in September 1979 ; 2) these are prime agricultural lands already in production and presently occupied. Secondly, we also oppose the proposed circulation road on the eastern and northern boundary of Kuhio Village as listed on Page 14, Item f. , as well as its diagram contained on Page 23 , as a hazard to health, safety and the general welfare of not only the residents of Kuhio Village, but also the other non resident Homesteaders who use this Village thoroughfare to reach their farmlots and ranchlots in the general area. Submitted herewith, as a matter of record, are petitions attesting to this opposition, including a copy of a letter dated June 9, 1981 from Councilman Kalani Schutte attesting that this road will be deleted from the Waimea Design Plan. Box 104 Kamuela, Hawaii 96743 Dear Ethel : In reply to your letter dated June 5, 1981, please be advised of the following : Item No. 1 : Kahilu Road Kahilu Road, as a collector road, will be deleted from the Waimea Design Plan starting at the intersection of Mana Road, and ending at the Kuhio Village boundary. As a result, the other proposed extension of Kahilu Road which would circumvent the eastern and northern boundary of Kuhio Village will also be deleted. The fact that Kahilu Road is a private road with limited access under the Department of Hawaiian Home Lands substantiates this position. Item No. 2 : Maintenance of Kahilu Road Kahilu Road, because it is owned by the Department of Hawaiian Home Lands and is considered a private road with limited access, is not applicable for County maintenance. The fact that Kahilu Road will be deleted from the Waimea Design Plan as a future "collector road", prevents any future consi- deration by the County for improvement at this time. • J ' COIINTY COUNCIL - County of Hawaii Mrs. Ethel Andrade, Pres. Box 1879 Honolulu, Hi 96805 ALOHA, Georgiana: As a matter of record, please be advised that our Association went on record last night at its quarterly meeting held at Kuhio Hale , that we are OPPOSED to the: 1) Proposed By-Pass Major Arterial Road, presently contained in the Waimea Design Plan which is a part of the County General Plan and scheduled for adoption at the next County Committee Meeting on Wednesday, June 17 , 1981 , at 7: 00 P.M. at the Town Hall , BISECT our Homesteaders ' pastoral and farm lots , on the basis that these are PRIME AGRICULTU"RAL LANDS ALREADY IN PRODUCTION AND OCCUPIED. • Lyn Flores presented this issue , with petition, to you in September 1980 at the Waimea Commission Meeting. We also addressed this issue to you in our letter of April 1 , 1981 • item 5, which you acknowledged on April 24, advising that these concerns would be responded to, at a later date. 2) Proposed secondary road circulating Kuhio Village from Kahilu Road at the corner of Lot #38, along that entire boundary, thence on and through Maertens Road, based on the fact that this unnecessary Road , in our opinion, will be a menace and threat to the health, safety, and general welfare of the residents , as well as to the other commuting Homesteaders residing elsewhere, but traversing this Village and reaching their pastoral and farm lots in the general area. BURGESS, fl • The Department of Hawaiian Home Lands (DHHL) has granted Trustee-At-Large permission to the Department of Transportation (DOT) MR.THOMAS K. KAULUKUKUI, SR., for a one-year permit beginning August 1, 1980, to Trustee-At-Large conduct an archaeological and geological survey. To MR. JOSEPH G. KEALOHA, JR. this date, the DOT has not conducted the survey due to Trustee from Maui lack of funds. MR.WALTER L RITTE, JR., Trustee from Molokai • History of the case; DR. A. LEIOMALAMA SOLOMON Trustee from Hawaii -- This case dates back to 1969, as indicated by DHHL files. Within those files are letters in support of the Mud Lane road project from homesteaders. I shared the following information with Ms. Padeken: 1. When Ms. Billie Beamer was the HHC Chairman, we (Flores, Beamer on December 6, 1976) questioned the legality of DHHL granting permission to the DOT to conduct a survey without homesteader's approval to enter their lands. [The reply from Ms. Padeken is that homesteader's 4 received permission requests and gave their approval, (p " 13 all except Francis K. Beamer, Sr. ] 2. When Flores and Beamer on October 17, 1977, sought the legal advice of Ben Gaddis (Legal Aid, Hilo Office) he, in turn, wrote to the HHC and inquired as follows: 567 So. (b) What effect, if any, the proposed route will have on Hawaiian Home lands leased to beneficiaries under Section 207 of the Hawaiian Homes Commission Act? (c) If lands leased to the beneficiaries are affected, what provision of the Hawaiian Homes Commission Act allows the Department to approve such use by non-Hawaiians? (d) If lands leased to beneficiaries under Section 207 are to be affected, what provision has been made for compensation to lessees for any anticipated loss of land? Ms. Padeken shared her mana'o with me (which I relayed to the Homesteader's Association) as follows: • The Homesteaders Association must submit their position to the HHC for consideration immediately. My input is as follows: 1. Results of homesteader's concerns should be chronologically documented to support their opposition to the proposed plan. For example, (a) Beamer and Flores' reports in 1977; (b) Lynn Flores' reports in 1979 at the Hawaiian Homes public meeting; etc. 2. Secure a commitment from the HHC and DOT as to their position on the Mud Lane Highway. 3. Copies should be submitted to these agencies: • Mayor Herbert Matayoshi • Chairperson of the Hawaii County Council • Hawaii County Planning Department • Planning Commission, Hawaii County • Chairman, State Board of Land & Natural Resources. Our organization, the Keaukaha Panaewa Farmers ' Association, is in support of your Association's petition opposing the secondary proposed road circulating Kuhio Village; seeking in- stead, its realinement or relocation. We are especially in opposition to any developments by the state; counties; or private individuals, parties or entre- preneur(s) ; that proposes or promote any development(s) close to, or thru the Hawaiian Homes Lands, especially the agricul- trual or pastorial lots; that will fragmentate, or displace any Hawaiian Homesteader or lessee(s).
