County Code 1983 (2005 Edition) (formerly referred to as Section 25-114, City of Hilo Zone Map,
Article 3, Chapter 25, Zoning Code) by Changing the District Classification From Single Family
Residential — 10,000 Square Feet (RS -10) to Neighborhood Commercial — 7,500 Square Feet
(CN -7.5) at Waiakea, South Hilo, Hawaii, Covered by Tax Map Key Nos.: 2-2-044:003, 031, 032,
035, and 037; Request: Amend Condition C (Secure Final Subdivision Approval), Condition H
(Drainage Improvements), and Condition I (Improve Kahaopea Street) of Change of Zone
Ordinance No. 99-116 (Applicant: Graphic Images Hawaii, Inc.; Area: 7.402 acres). If the
applicant, successors, or assigns develop residential units or lots on the subject properties, the
applicant, successors, or assigns shall make its fair share contribution to mitigate the potential
regional impacts of the development with respect to parks and recreation, fire, police, solid waste
disposal facilities and roads. The fair share contribution shall have a maximum combined value of
$7,903.35 per multiple family residential unit ($12,316.47 per single family residential unit).
AYES: Council Members Blas, Hoffmann, Ikeda, Onishi, Smart, Yoshimoto, and Chair Yagong —
7; NOES: Council Members Ford and Pilago — 2; ABSENT: None; EXCUSED: None.
Bill 263 (Draft 2): Amends Chapter 2, Article 40, Section 2-207 of the Hawaii County Code 1983
(2005 Edition, as Amended), Relating to the Scope and Duties of the Environmental Management
Commission. Amends Chapter 2, article 40, section 2-207 by adding language relating to the
following: The environmental management commission shall advise the department on solid waste
and wastewater programs and to include any pilot project or program; comments or
recommendations by the commission shall be forwarded to the council; and that prior to council
action, the director and commission shall submit comments and recommendations on all legislation
relating to the functions and duties of the department, including any ordinance that amends chapters
20 or 21 of this Code, and further states that the comments and recommendations shall be provided
to the council within 45 days of receipt. AYES: Council Members Blas, Ford, Hoffmann, Ikeda,
Pilago, Smart, Yoshimoto, and Chair Yagong — 8; NOES: None; ABSENT: Council Member
Onishi — l; EXCUSED: None.
