Pursuant to Hawai`i County Charter, Article III, Section 3 -12, the Mayor may veto any
item or portion thereof and the item or portion thereof so vetoed shall not take effect
unless the Council shall reconsider the vote on the bill and, upon such reconsideration,
the bill is again passed by the affirmative vote of two - thirds of the entire membership;
and pursuant to Article X, Section 10 -5, if the veto is not overridden the operating budget
as submitted by the Mayor shall be deemed adopted by the Council as the operating
budget for the ensuing fiscal year.
I hereby certify that the following Ordinance was reconsidered at the meeting of the
County Council on June 30, 2011; however, it failed to obtain the affirmative two - thirds
vote of the entire membership, as listed below:
Bill 29 (Draft 4): An Ordinance to Establish an Operating Budget for the County of
Hawai`i for the Fiscal Year July 1, 2011 to June 30, 2012. AYES: Council Members
Ford, Hoffmann, Pilago, Smart, and Chair Yagong — 5; NOES: Council Members Blas,
Ikeda, Onishi, and Yoshimoto — 4; ABSENT: None; EXCUSED: None.
Therefore, Bill 29 (Draft 2), as submitted by the Mayor is deemed adopted by the Council
as the operating budget for the ensuing fiscal year:
Ordinance 11 -59 (Bill 29, Draft 2): An Ordinance to Establish an Operating Budget for
the County of Hawai`i for the Fiscal Year July 1, 2011 to June 30, 2012.
