on November 6, 2013, by vote as listed below:
Bill 120, Draft 2: Amends Section 25-8-26 (PahoaZone Map), Article 8, Chapter 25 (Zoning Code) of
the I lawai`i County Code 1983 (2005 Edition), by Changing the District Classification from
Agricultural— 1 Acre (A-1a) to Village Commercial — 10.000 Square Feet (CV-10) at Keonepoko lki,
Puna, Hawaii. Covered by `I MK:1-5-007:006, 069 & 070; Applicant: B. T. Kuwahara, LLC. If the
applicant, successors, or assigns develop residential units on the subject properties, the applicant,
successors or assigns shall make its Mir share contribution to mitigate the potential regional impacts of the
development with respect to parks and recreation, fire, police, solid waste disposal facilities and roads.
The fair share contribution shall have a maximum combined value of$8,394.57 per multiple family
residential unit ($13,081.99 per single family residential unit). AYES: Council Members Eoff; Ford,
Ilagan, Kanuha, Kern, Onishi, Poindexter, Wille, and Chair Yoshimoto 9; NOES: None;
ABSENT: None; EXCUSED: None.
Bill 135: Amends Chapter 14 of the Hawai`i County Code 1983 (2005 Edition, as Amended), by Adding
a New Article Relating to the Distribution of Tobacco Products. Makes it unlawful for any person to
distribute a tobacco product to any person under 21 years of age, to take effect on July 1, 2014. Those
persons at least eighteen years old on or before July 1, 2014, would be exempt from this law.
AYES: Council Members Eoff, Ford, Ilagan, Kanuha, Kern, Onishi, Poindexter, Wille, and
Chair Yoshimoto—9; NOES: None; ABSENT: None; EXCUSED: None.
Bill 138: Amends Ordinance No. 13-66, as Amended, Relating to Public Improvements and Financing
Thereof for the Fiscal Year July 1, 2013 to June 30. 2014. Adds the Public Works Nani Kailua Extension
project for $3.5 million to the Capital Budget. Funds for this project shall be provided from the General
Obligation Bonds, Capital Projects Fund-Fund Balance and/or Other Sources (State Capital Improvements
Project). AYES: Council Members Eoff, Ford. Ilagan, Kanuha, Kern, Onishi, Poindexter, Wille, and
Chair Yoshimoto—9; NOES: None: ABSENT: None: EXCUSED: None.
Bill 139: Amends Chapter 24, Article 10, Division 2 of the Hawaii County Code 1983 (2005 Edition, as
Amended), Relating to Moving Vehicles. Amends Section 24-271, Schedule 19 (Prohibited left turn
areas), Subsection (c), South Hilo, by adding"Barenaba Lane at Kilauea Avenue." AYES: Council
Members Eoff. Ford, Ilagan, Kanuha, Kern, Onishi, Wille, and Chair Yoshimoto— 8; NOES: None;
ABSENT: Council Member Poindexter— I: EXCUSED: None.
Bill 140: Amends Chapter 24, Article 10. Division 2 of the Hawai'i County Code 1983 (2005 Edition, as
Amended). Relating to Moving Vehicles. Amends Section 24-265, Schedule 13 (Yield locations),
Paragraph (g). Puna, by adding "North Oshiro Road, Southeast approach to bridge adjacent to
parcels (3)1-8-005:029 and (3)1-8-073:003." AYES: Council Members Eoff, Ford, Ilagan, Kanuha,
Kern, Onishi, Wille. and Chair Yoshimoto-- 8; NOES: None; ABSENT: Council Member Poindexter
— 1; EXCUSED: None.
