Kailapa Community is a Hawaiian homes subdivision of 191 lots set aside for 50% Native
Hawaiians.The current population of Kailapa is around 650-700 people who live here.
We oppose the acceptance of the easement for the following reasons
• The Ala Loa is an ancient historic trail that our ancestors once walked on and is
protected for public access by King Kamehameha 1 "the law of the splintered
paddle and well as the hwys act of 1892. It is irrelevant what wrongs were done by
the "State",the County or planning dept.Those wrongs need to be corrected and the
Ala Loa needs to be restored. Hewa upon hewa does not make Pono.
• This area is historically used for subsistence fishing. Noted in the cultural impact
assessment for the Kohala Kai development and Papa Akau strongly said the
"traditional trail system be protected and kept open for pedestrian access", in this
same document it indicates that the public pedestrian easement has already been
established that parallels the shoreline, additionally there is a mauka/makai access
from Akoni Pule Hwy along the northern boundary. The pubic access easement will
be maintained as part of the proposed Kohaka kai development and serve to
mitigate ay impacts related to coastal access and use of shoreline for fishing"
• Subsistence fishing is a way of life that is eroding away much due to blocked or
difficult access to the ocean.
• The Ala Loa extends from Polulu to The Ka'u district, developers continually destroy
our history for the almighty dollar. Creating barriers along the way.What is Hawaii
without our history, our culture and way of life.What will we have left to pass on to
our children if the degradation of our sites are allowed by those who were placed
into position to serve and protect our'aina.
• No one from this development ever came to us to share what they are doing or ask
for our input prior to it happening.We are the residents of this area.We are the
kanaka maoli of this land,it is OUR kuleana to protect our culture,traditions and
way of life for our future generations.This is testimony in itself of how the
developers view the importance of Hawaii's unique culture and values
• There is no mention of the developer contacting any native Hawaiian organization
or the Office of Hawaiian affairs.The National Historic Preservation Act
Amendments of 1992 (P.L. 102-575) included a requirement for consultation with
Native Hawaiian groups.The act explicitly names the Office of Hawaiian affairs as
such an organization.Who has been consulted?
• We believe that if this development is allowed to take the Ala Loa and provide a
little shoreline "fishermen's"trail along the cliffs this will set the standard for all
developments along our shoreline
• We humble ask that this Finance Committee take the responsibility to set this right
and NOT accept the unsafe public assess as proposed and require the restoration of
the Ala Loa for perpetuity
