Aloha, My name is roger Kanealii, I am a resident of Kailapa and a kanaka maoli.
I oppose the acceptance of the public shoreline access as proposed by Kohala Kai ,
LLC
• I am personally insulted that this development has been in the planning
process for many years , yet not once did anyone come to our community
who will the most impacted by the development to talk to us. Many of our
families have used this area for subsistence fishing, religious practices and
recreation for generations.
• The most insulting issue is that the developers feels they have the right to
use the Ala Loa for their private use and deny the public access on the trail
our ancestors created and have promised to us through the Law of the
splintered paddle. For those of you who are not familiar it says
• "Oh my people, Honor thy god. Respect alike men great and humble, See to
it that our aged, our women and our children he down to sleep by the
roadside without fear or harm , Disobey and die." Kamehameha I. We could
travel safely on the Ala Loa, we CANNOT travel safely on the constructed
shoreline trail.
• Further protections come from the The Highways Act of 1892. The year
before the overthrow of Queen Liliu'okalani, her government declared that
all roads, trails, paths, etc. then in public use were the property of
government in perpetuity and therefore available to all people.
• The shoreline access provided by the developers as a "fishermen's trail" is
dangerous, and not acceptable in any way. Our "Aina is under constant
attack by developers that are here to make money regardless of the impact it
has on our people and our culture. As leaders of our island, I humbly ask that
this committee do what is Pono and stop this NOW. Do not let this happen
here or on any new development along our shoreline. Do not allow any more
of our cultural or historical trails/sites to be destroyed or blocked from
access.
• I as a tax payer, do not feel I should be paying for the maintenance and
insurance for this unsafe alternate "fishermen's trail" as constructed by the
developers at a cost of$40,000 (Charlie Anderson) This is just NOT
acceptable
