RESOLUTION No. 220 86
(AMENDED)
WHEREAS, recent amendments to the Department of Transportation' s
Rules and Regulations of the Periodic Safety Inspection of Vehicles
program have been extensively criticized as being unfair and
overburdening to the operators of inspection stations ; and
WHEREAS, the Hawaii County Council received overwhelming
testimony against its proposal to increase the certificate of
inspection fee which would have compensated inspection stations for
the additional inspection work being imposed by the new amendments ;
and
WHEREAS, public testimony also presented arguments that the
inspection program had no correlation to the number of traffic
accidents , thus serving no public purpose; and
WHEREAS, the Hawaii County Council in adopting its Bill 260,
repealing Chapter 24, Article 5, of the Hawaii County Code relating
to inspection of vehicles , intended to send forth a clear message
that the County of Hawaii would not be a participant in the
enforcement of the State ' s Periodic Safety Inspection of Vehicles
program effective June 30, 1987 ; and
WHEREAS, it is the position of the Hawaii County Council that
rules and regulations should be enforced by the department or agency
responsible for their promulgation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it requests the Honorable George R. Ariyoshi, Governor
of the State of Hawaii; the Fourteenth State Legislature and the
Department of Transportation to assess the Periodic Safety
Inspection of Vehicles program to insure that it serves a justified
and functional purpose .
BE IT FURTHER RESOLVED that based upon the overwhelming
testimonies received at the public hearings , the Council hereby
requests that the Rules and Regulations relating to the Department
of Transportation' s Periodic Safety Inspection of Vehicles program
be abolished.

BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
transmit copies of this resolution to the
Honorable George R. Ariyoshi , Governor of the State of Hawaii ; the
Honorable Richard S. H. Wong, Senate President ; the
Honorable Henry H. Peters , Speaker of the House ; Big Island
Legislators ; Maui County Council ; Kauai County Council ; City &
County of Honolulu County Council ; and Mr . Wayne Yamasaki , Director
of Transportation .
