COUNTY OF HAWAII STATE OF HAWAII
RESOLUTION No. 210 "G
WHEREAS, Section 10-11 of the County Charter provides that
any contract, lease or other obligation requiring payment of funds
from appropriations of a later fiscal year or of more than one
fiscal year be approved by resolution of the County Council; and
WHEREAS, the County of Hawaii has entered into agreements for
the purchase of certain condominium office units at the Hilo
Lagoon Centre for the respective relocations of its Department of
Civil Service, Department of Liquor Control and Office of the
Corporation Counsel; and
WHEREAS, the County Council has previously appropriated funds
for the relocation of said county offices; and
WHEREAS, the ownership of the respective office units under
said purchase agreements require the payment of common expenses,
which includes maintenance of the common areas, electricity, water
and sewer services; and
WHEREAS, said common expenses must be paid by the County of
Hawaii beyond the present fiscal year and for more than one fiscal
year so long as title to said office units are held by the County;
NOW, THEREFORE, BE IT RESOLVED by the Council of the County
of Hawaii :
1. That it approve and authorize the payment of said common
expenses to the Association of Condominium Owners of the Hilo
Lagoon Centre beyond the current fiscal year ; and
2. That sufficient funds be budgeted in future fiscal years
to cover the legal obligations of the County for the common
expenses appurtenant to the ownership of its office units.

Dear Chairman Yamashiro:
The County of Hawaii has entered into agreements for the purchase of certain condo-
minium office units at the Hilo Lagoon Centre for the respective relocation of its
Department of Civil Service, Department of Liquor Control and Office of the Corpor-
ation Counsel.
The purchase agreements require, as a condition of ownership of the condominium
units, the payment of common area expenses which are presently $4,307.02 per month.
Payment of these common area expenses must be made so long as title to said office
units are held by the County. Attached is a Resolution requesting Council approval
to authorize the payment of said common expenses and that sufficient funds be budgeted
in future fiscal years to cover these common expenses.
