RE: ORDINANCE AMENDING CHAPTER 11,HAWAII COUNTY CODE 1983 (2005
EDITION, AS AMENDED), RELATING TO AFFORDABLE HOUSING POLICY.
Ordinance 12-81 enabled developers to convey finished lots and infrastructure to non-profits as a
means of satisfying their affordable housing requirement. Under Section 11-8(a), only
developers who directly satisfy the requirement by constructing the affordable dwelling units for
sale or rent are entitled to a density bonus.
The proposed amendment provides a density bonus to developers who convey finished lots and
infrastructure, where the non-profit is constructing the affordable for-sale or rent units.
Enclosed is an ordinance amending Chapter 11, Hawaii County Code 1983 (2005 Edition, as
amended), relating to affordable housing policy.
