Re: Amendment to the Hawai`i County Code
Enclosed is a bill for an ordinance amending Chapter 21, Section 21-32, of the Hawai`i County
Code 1983 (2005 Edition, as amended), relating to Billing of Charges; Payment; Late Penalty.
The amendment of this section authorizes the termination of water services for non-payment of the
sewer services charges levied pursuant to this chapter, when so directed by the Director of
Environmental Management, after due notice and opportunity for a hearing as provided by Chapter
91, HRS before the Environmental Management commission, and the resolution of any appeal
therefrom.

A. REQUEST:
To amend HCC Chapter 21, Section 21-32. Billing of charges; payment; late penalty, by adding:
(f) The Department of Water Supply is authorized to terminate water services for non-payment of the sewer
services charges levied pursuant to this chapter when so directed by the Director after due notice and
opportunity for a hearing as provided by Chapter 91, HRS before the Environmental Management
Commission and the resolution of any appeal therefrom.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The Department of Environmental Management (DEM) requests that the Hawai'i County Code be amended
to give the Department of Water Supply (DWS) authorization to terminate water services for non-payment of
sewer fees. Collection of past due sewer fees has been a long standing challenge for the DEM due to the
inability to discontinue services for non-payment. Discontinuing water service is the only safe way to
discontinue sewer service as plugging sewer lines would create health and safety concerns. The ability to
discontinue services will provide the DEM the necessary leverage to improve collections and to prevent
additional delinquencies.
