ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 6, SECTION 24-288
OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO
FREIGHT LOADING ZONES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The purpose of these measures is to update the Hawai`i County Code to
match what exists in the field.
SECTION 2. Chapter 24,Article 10, Division 6, Section 24-288, Schedule 36. Freight
loading zones, subsection (c), South Hilo, of the Hawai`i County Code 1983 (2005 Edition, as
amended), is amended by deleting existing item and renumbering as required:

north of Banyan Way and extending thirty seven feet in the northerly direction.]
SECTION 3. Chapter 24, Article 10, Division 6, Section 24-288, Schedule 36. Freight
loading zones, subsection(c), South Hilo, of the Hawai`i County Code 1983 (2005 Edition, as
amended), is amended by adding new item and renumbering as required:
( ) Banyan Drive,northwest(makai) side, from a point three hundred thirty-four feet
northeast of the northern intersection of Lihiwai Street and extending forty four feet
in the northeasterly direction.
SECTION 4. Material to be repealed is bracketed and stricken. New material is underscored. In
printing this ordinance, the brackets,bracketed and stricken material and underscoring need not be
included.
SECTION 5. Severability. If any provision of this ordinance, or the application thereof
to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or application,
and to this end, the provisions of this ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon its approval.
