Caiinittee Meeting of December 3, 1998 are herewith submitted: - The Secretary's minutes of the Executive Committee Meeting of October 23, 1998 were approved and placed m file (Attached for information). The Treasurer's report for October 1998 was approved and placed on file (Attached f_or information). Under NACo Reports, Board Member Ron Kouchi suggested that Hawaii County apply '` to host the Western Interstate Region Conference slated for 2001. t , Under New Business, each County was encouraged to develop a Y2K Preparedness Plan. In addition, President Mansho circulated Resolution 98 -343 regarding establishing a County "Administrative Fee" for every traffic citation issued. - The next HSAC Meeting is planned for January 1999 on Oahu. EXECUTIVE COMMITTEE MEETING MINUTES After incorporating a correction (to indicate that the Executive, Committee; did not refer to the respective councils a proposal relating to,;legislative, :;: bodies' subpoena power for possible inclusion in the 1999. ;HSAC .':":: Legislative Package), the HSAC Executive Committee approved :;the.; minutes of its meeting held on August 27, 1998. III. TREASURER'S REPORTS The Treasurer's Reports for the months of August 1998 and September 1998 were approved. IV. REPORTS 1 A. Nakamura, HSAC Secretary to President Mansho, dated October 14, 1998, reporting Executive Committee approval of a $1,000 reimbursement to Calvin Azama for the HSAC Mid -Year conference held in December 1992. • B. County Report The following County Report was placed on file: 1. From C. Bunji Shimomura, Kauai County Clerk to President Mansho, dated October 2, 1998, reporting adoption of Resolution 50 -98, Resolution Supporting National Pollution Prevention Week. C. NACo Report The following NACo Report was placed on fi le: 1. Memorandum from Diane S. Shea, Associate Legislative Director, Environment, Energy and Land Use, to Environment, Energy and Land Use Steering Committee and State Association Executive Directors, dated September 21, 1998, providing a monthly legislative /regulatory briefing. NACo Board members Ron Kouchi and Dennis Nakamura will be attending the next meeting of the NACo Board of Directors in Asheville (Buncombe County), North Carolina, December 10 -12, 1998. V. UNFINISHED BUSINESS A. Support for NACo's Position Opposing Federal Preemption of Local Zoning Authority over Satellite Broadcast on Cellular Phone Antennas The purpose of this item is to act on a resolution supporting NACo's position opposing federal preemption of local zoning authority over satellite broadcast on cellular phone antennas. Pending action by Maui County, this item was deferred. Letters of support for NACo's position were received from three members of Hawaii's Congressional delegation: Congresswoman Patsy T. Mink (September 30, 1998), Senator Daniel K. Akaka (September 30, 1998), and Senator Daniel K. Inouye (October 8, ,.._11/ MU:\ 14:18 FAX 808 243 7686 MAUI CUUNT1 CUUAUIL tuu. 0 0 1998). Senator Inouye noted that NACo's position has prevailed in the 105 Congress. B. Support for the Proposed Amendment to the Internet Tax Freedom Act The purpose of this item is to act on a resolution supporting NACo's endorsement of the proposed amendment to the Internet Tax Freedom Act. Pending action by Maui County, this item was deferred. President Mansho reported that NACo's legislative staff has provided the following report on this matter: "In a big win for state and local governments, the Senate passed the Internet Tax Freedom Act (S.422) on October 8. The bill contains many provisions supported by NACo and is an improvement over similar legislation (H.R. 4105) passed by the • House in June. The House and Senate leadership decided there was not enough time to hold a conference to negotiate differences between the two bills. They agreed to accept the Senate bill and to add it to the omnibus appropriations bill. The bill contains several provisions supported by NACo and the other state and focal government groups [including]: • a strong grandfather clause protecting existing state and local Internet taxes; [and] • a three -year moratorium on new Internet taxes? C. Support for the 1999 HSAC Legislative Program Policy Statement The purpose of this item is to act on a resolution to approve the 1999 HSAC Legislative Program Policy Statement. Pending action by the City and County of Honolulu, this item was deferred. D. Discussion of Proposals for the 1999 HSAC Legislative Package The purpose of this item is to discuss proposals for the 1999 HSAC Legislative Package. The Executive Committee noted that it previously referred to the counties for their approval a legislative proposal to provide liability relief for county skate parks. Maui 11/09/98 MON 14:19 FAX 808 243 7686 MAUI COUNTS COU`CIL l{7JUUJ 0 0 County and Hawaii County reported that they have approved this proposal for inclusion in the 1999 HSAC Legislative Package. Al Smith provided the Executive Committee with a memorandum dated October 22, 1998, from Hawaii County Council Chairman James Y. Arakaki to HSAC President Rene Mansho, with supporting materials, informing that the Hawaii County Council has approved for inclusion in the 1999 HSAC Legislative Package a legislative proposal relating to condominium property regimes. This proposal was originally submitted by Hawaii County Councilmember Curtis Tyler and is modeled after S.B. No. 3195 (1998), S.D. 1. The purpose of the proposed legislation is to ensure that projects created and established as condominium property regimes are subject to the provisions of underlying county zoning and county subdivision and development ordinances and rules. The Executive Committee received the following documents in reference to a legislative proposal relating to cable - television franchise fees for county telecommunications programs: 1. A draft proposed Honolulu City Council resolution entitled "RELATING TO A LEGISLATIVE PROPOSAL FOR INCLUSION IN THE 1999 HSAC LEGISLATIVE PACKAGE THAT WOULD PROVIDE CABLE TELEVISION FRANCHISE FEES FOR COUNTY CABLE COMMUNICATIONS PROGRAMS" from President Mansho. 2. A document entitled "Proposed Legislation for HSAC 1999, 'Local Government Participation in Communications Infrastructure' from Sean McLaughlin, Executive Director of Akaku: Maui Community Television. The documents were drafted in response to a presentation made by Mr. McLaughlin and Jeff Garland, of Hawaii Public Access Media, at the Executive Committee meeting of August 27, 1998. The purpose of the legislation referred to in both of the above - referenced documents is provide the counties with (1) some portion of the revenues from cable- franchise fees; and (2) the authority to establish community -media policies and programs within each county. The Executive Committee voted to refer the following proposals for the 1999 HSAC Legislative Package to the counties for their approval: 11709/98 1MON 14:20 FAX_ 808 243 7686 MAUI COUNTY COUNCIL lC 006 1. Proposed bill proposed bill relating to condominium property regimes (proposed by Hawaii County Council). 2. Proposed bill relating to cable - television franchise fees for county telecommunications programs (proposed by HSAC Executive Committee, by request of Sean McLaughlin, Executive Director of Akaku: Maui Community Television). VI. NEW BUSINESS A. 1998 Mid -Year Conference Advancement The purpose of this item is to act on a request to approve a $1,000 advance for the 1998 Mid -Year Conference to be held on December 3rd and 4th at the Kauai Marriott Resort and Beach Club. The Executive Committee approved the requested advance. B. Supporting the Westem Governors Association and NACo "Enlibra" Policy The purpose of this item is discuss support for the WGA and Western Interstate Region (a subset of NACo) policy of "Enlibra" regarding a balanced environment. The matter was referred to the counties for their approval as an HSAC policy statement. C. Supporting Collaborative Partnerships Between the College of Tropical Agriculture and Human Resources (CTAHR) and the Counties The purpose of this item is to discuss support for the establishment of collaborative partnerships between CTAHR and the counties. The matter was referred to the counties for their approval as an HSAC policy statement. VII. COMMUNICATIONS No communications were placed on file. VIII. ANNOUNCEMENTS A. The next meeting of HSAC Executive Committee was tentatively scheduled for Monday, November 23, 1998 in the Honolulu Council Committee Meeting Room. B. The hotel- registration deadline for the HSAC Mid -Year Conference (December 3-4, 1998, Kauai Marriott Resort and Beach Club) is 11/09/98 MON 14:20 FAX 808 243 7686 MAUI COUNTY COUNCIL WJUV7 0 0 November 2, 1998; the conference - registration deadline is November 20, 1998. The conference theme is "Government's Influence on the New Millenium: Business & the Economy —How Do We Adapt ?" C. The Executive Committee members were requested to seek approval from the respective council chairs for the following proposed schedule for future HSAC conferences: CONFERENCE DATE HOST COUNTY June 1999 Hawaii December 1999 Maui June 2000 Kauai December 2000 Honolulu D. Dennis Nakamura reported that the State Office of Planning, using Federal funds, has convened the Hawaii Geographic Information Coordination Council ( HIGICC). The HIGICC's primary purpose is to develop uniform statewide standards for GIS (Geographic Information Systems). Individual counties or HSAC itself could be considered for membership on the HIGICC. Dennis Nakamura reported that the Maui County Council participated in NACo's satellite broadcast entitled "Local Government and the Year 200 Bug" on October 7, 1998.
