Council Members Hawaii County Council 75 Aupuni Street, Room Hilo, HI 96720 Subject: Resolution 104 — 13, Kohala Kai Subdivision GOE Members of the Hawaii County Council, The members of the Board of Directors of E Mau Na Ala Hele (E Mau) believe that the Ala Loa/Jeep Trail is the most appropriate route for lateral public access at Kohala Kai (KK). The Ala Loa has been used for centuries by Island people. The developer's attorney earlier testified before this committee that the Ala Loa does not legally exist at Kohala Kai. His statement is incorrect. The land trade made by the territory of Hawaii many decades ago only indicates that KK now owns the property on which the Ala Loa rests. The Ala Loa legally exists on Kohala Kai property as a significant cultural and historical site. It is recognized as such by the State of Hawaii, the National Park Service, and Native Hawaiian organizations. Just as the burials and other significant cultural and historical sites have been protected on Kohala Kai property, the Ala Loa and the right to walk in the footsteps of Hawaiian kupuna must be preserved and protected. Unfortunately, the Planning Department did not provide for the legally required, timely, public input that could have avoided this controversy. Today, the Planning Department is expecting you to approve a Grant of Easement for public access that we believe does not meet common sense standards. I have attached a few photos to my testimony to help explain. Photo #1: Public access on the paved shoulder of a 55 mph highway? It is not safe especially for families with children. Photos #2 -#4, at the Rocky Beach Kiawe steps in photo #3 on a dangerous eroding slope? Doesn't make sense. The trail across the beach can be dangerous during annually occurring surf. The walker in photo#4 was lucky to have made it across the rocky beach without incident. The public access easement should include a safe, alternative route mauka of the beach. Photos #5 - #10 Public access located where storm surf will wash away trail improvements? And putting the trail on unstable ground, next to precipices that are subject to wave erosion and earthquakes? Per Resolution 104, the County is responsible for maintaining, rebljilding(�3y 3, 37 Ref.Dote rEB 1 R 2nt4 , and relocating the Developer located/Developer built trail. Please take the fiscally responsible position of ensuring that the public access is located sufficiently inland. This means rejecting where it is presently located in Kohala Kai LLC's Grant of Public Access Easements. Photos #11 and #12 Sections of the historic Ala Loa are paved with red cinder and scheduled to become a golf cart path for the gated community of Kohala Kai. Photo # 13 Please compare photos #11 and #12 with photo #13. If the GOE is approved by the County Council, photos 11 and 12 are of the future, private, golf cart path located on the historic and culturally significant Ala Loa. And photo number 13 is where residents will walk on the nearby public access. The trail in Photo# 13 also would become a section of the Ala Kahakai National Historic Trail. Please be a positive force for creating sensible, permanent public access with public input, and realistic trail design. Please do not approve the existing Kohala Kai public access.
