Dear Members of the Hawaii County Council:
I write to you as testimony in the matter of Resolution 104— 13,Kohala Kai Subdivision
GOE.I object to the incorrect planning procedures by the Hawaii County Planning
Department and illegal steps taken by Kohala Kai that have resulted in there being no
appropriate `Ala Loa or Na Ala Hele through the property being developed by Kohala
Kai. Four main points of concern are:
1)The `Ala Loa is a protected heritage landmark recognized by the State of Hawaii,the
National Parks,and by Native Hawaiians. It does not matter who owns the land. It does
not matter if one person observed no Native use of it during one observation. Nothing
has changed,and nothing will change the fact that the `Ala Loa is protected and must be
respected and protected.
2)The 'Ala Loa as adjusted and changed by Kohala Kai is unsafe and appropriated for
other uses. As Kohala Kai revised the `Ala Loa it is now on the highway shoulder,on
unstable ground,and most of it is under water whenever there is high surf The 'Ala Loa
has become the developer's"lateral shoreline access"and separate from the"mauka
makai access",which includes the shoulder of Akoni Pule Hwy. Much of the developer's
shoreline access is subject to high surf which could wash away any trail improvements
curbstone,etc.
3)Through many years there was never public input in several decisions by the county
planning department,which changed the requirements for Kohala Kai to benefit the
developer.
4)Correct decision on this matter should not be delayed or postponed again. Public input
is necessary on every decision that the planning department made on matters where
public input was required,for Kohala Kai and any other property or development.
