Subject: Bill 144 Amends Section 25-8 (North Kona Zone Map)Article 8 Chapter 25
(Zoning Code) of the Hawai'i County Code 1983(2005 Edition), (By Changing the
District Classification From Agricultural—Five Acres (A-5a) To Single—Family
Residential— 15,000 square Feet (RS-15) at Kahului 2nd, North Kona, Hawaii,
Covered by TAX KEY 7-5-017-43 (Applicant: Hualalai Partners of Kona, LLC,
approximately 14.968 acres)

My name is Marie Aguilar and I am a homeowner on Heinaloli Road. My mailing
address is P.O. Box 1874, Kailua Kona, 96745. I have resided in this community
neighborhood for over thirteen years. Each day I drive on Hualalai Road back and
forth from my home to my business in Historic Kailua Village. My testimony has been
heard by the Land Use Committee Hearings. There should be conditions and or
amendments to Bill 144 which requires improvements for the substandard Hualalai Road
which fronts this parcel. The proposed amendments written by Council Member, Brenda
Ford provides the necessary conditions to make this created subdivision accountable to
the residents living nearby and to the County of Hawai'i.
I wish to address issues on Bill 144- Changing the Zoning Codes from A-5a to RS-15
for Hualalai Partners. The most important concern is public safety on Hualalai Road
during construction and when residents of this development have moved into their
homes. There will be an increase in large construction vehicles which will travel on
Hualalai Road with building materials,tons of concrete in mixing trucks, and heavy duty
excavation equipment. Residents who travel on Hualalai road will be using this road to
travel to their jobs. The County of Hawai'i through the Department of Public Works
must clearly require essential safeguards for traveling on Hualalai Road. The proposed
Amendments submitted by Councilor, Brenda Ford, definitely provides those conditions.

I wish to endorse the proposed Amendments stated as Condition"C", Condition"L", and
a new Condition"R", and new Condition"S". All of the Conditions
listed here directly address the publics concerns for the proposed development owned
by Hualalai Partners. Condition"C" for the required Bond for completion of Streets,
including curbs, gutters, sidewalks and street lighting as required by the Department of
Public Works grant the surety for completion. Condition"L" for a flood control system
to include addressing off—site drainage entering and exiting parcel TMK:7-5-:017-043
insures that subdivision will have proper drainage improvements. Condition"R"is
justified by stating the number of lots in this re-zoning to forty lots. The landscape of the
acreage and has country characteristics. It is welcoming that the larger lots will beautify
the landscape and keep"Kona Country". Condition"S" is a measure that will allow
affordable housing within this subdivision. Explicit requirements are aligned for this
protection.
While Condition"G"is meant to provide the extension of Pualena Street there is more
testimony needed to clarify the exact location of a connector road through to Hualalai
Road. I cannot endorse this Condition"G" as it is not clear if there would be two
connector roads to Hualalai Road. This subdivision would not benefit with two Hualalai
Road access connection roads due to the location of the new Waiaha Water System tank
and the blind curves on Hualalai Road.
Thank you for your consideration today. I believe my written testimony for favored
listed amendments have merit. Mahalo to all the County Councilors who have worked
with the residents in the area. When allowing this development make sure it is workable
for the future. Please make sure that the Kona CDP is within the legal limits of
this development so that there will be no problems in the future.
