RE: OBJECTION TO RESOLUTION NO. 140-13, DRAFT 3. KOHALA KAI LLC
Dear County Council Members:
My name is Ms.Jojo Tanimoto, I live in Kawaihae approximately a mile away
from this Kohala Kai subdivision. Thank you for the opportunity to OBJECT to
the proposal to accept the ancient Ala Loa Trail by identifying this historic trail
as "Public Access".
Whereas,everyone and everything is identified by a name. The subject today
seriously"skirts", or tries not to identify this easement as part of a larger"historic"
Ala Loa Trail system.
Whereas,there are Ala Loa Trails on at least the major islands of this state.
Whereas, by not correctly identifying this significant Trail,the lawful responsibilities
to preserve, protect and restore this alignment for public use impacts other laws
protecting Hawaii's cultural, economics, fishing, historical, marine life, traditional
practices, and all that is valuable to Hawaii State and the people who live in Hawaii.
Whereas, Resolution 140-13, draft 3 requests the Hawaii County accept this
easement as a "public access" is objectionable. The Hawaii County needs to recognize
how important it still is, to be able to walk from one place to another,that trails lead
to food subsistence,gathering rights, etc.
Therefore,the Ala Loa Trail is historical and protected by other laws than the Hawaii
County Code.
Therefore, Resolution No. 140-13, Draft 3 mentions Hawaii County Code pertaining
to "public access" and a means to accept this easement, and the intent is to use this
Trail as a public access under restrictive means; the identity and responsibilities to
preserve, protect and restore historic significance need to be incorporated in this
Resolution.
Therefore and most importantly,The Ala Loa Trail needs to have the name restored.
