Oppose
Aloha County Council Members,
I once again testify to oppose the acceptance of the easement under
Resolution 140-.13
I acknowledge and appreciate the work that the Council members
attempted to negotiate with the developer and the community regarding
use and care of the Ala Loa, however the underlining issue has not been
addressed nor resolved.
As research continues, more and more information is being recovered that
supports our stand that the Ala Loa remains the public access and
protected by law and safe passage guaranteed by Kamehameha, then the
ruler of Moku Keawe.
The Ala Loa is property that is considered incident to the principal property
for purposes such as passage of title, conveyance, or inheritance to the land
of the government in perpetuity, not to be separated.
I strongly request that you please follow the laws that were put in place to
protect us. Table Resolution 140-13; until the determination of the Ala Loa
ownership, control and maintenance is addressed and settled. I believe the
Ala Loa IS the public access and we as community, as individuals and you as
our Representatives have the kuleana to preserve, protect and malama the
ancient trails including the Ala Loa for perpetuity.
