ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 5, SECTION 24-280,
SCHEDULE 28 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED),
RELATING TO NO PARKING AT ANYTIME.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. This amendment is being proposed based on public concern that cars
parked on the north side of Paniolo Place are within the travel way. Paniolo Place is a County road
with a fifty foot right-of-way. The subject pavement width is approximately thirty-three feet wide
with the northern twenty feet for vehicular travel and the remaining thirteen feet serving as a
shoulder. This amendment would restrict parking on the north side of Paniolo Place while
continuing to allow parking on the south side of same.
SECTION 2. Chapter 24, Article 10, Division 5. Section 24-280. Schedule 28. No
parking at anytime, paragraph (e) Kohala be amended by adding new item and renumbering as
required:
( ) PANIOLO PLACE, NORTH SIDE.
SECTION 3. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed and stricken material and
underscoring need not be included.
SECTION 4. Severability. If any provision of this ordinance or the application thereof
to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or application,
and to this end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
