Re: Amend Zoning Code List of Preemptions
The County's Office of Housing and Community Development (OHCD) proposes to amend item
1.13 in the List of Preemptions provided in"Exhibit C" attached to Resolution No. 416-07,
which waives the requirements of Section 25-5-7 of the Hawai`i County Code.
Enclosed is a resolution to amend the List of Preemptions described above, as indicated in the
attached "Exhibit A", where material to be repealed is bracketed, and material to be added is
underscored.
The Office of Housing and Community Development requests that this resolution be waived
from Committee, and be placed on the April 1, 2014 Council Agenda so that building permits
can be processed as soon as possible. If you have any questions, please do not hesitate to contact

A. REQUEST:
Resolution to amend Item 1.13 in the List of Preemptions provided in "Exhibit C" attached to Resolution No.
416-07, which waives the requirements of Section 25-5-7 (Hawai'i County Code) pertaining to minimum
yards.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
WHEREAS, on September 7, 2006, the Hawai'i County Council adopted Resolution No. 439-06, which
designated the Waikoloa Workforce Housing Project as an "Experimental and Demonstration Housing
Project" as provided by Section 46-15, Hawai'i Revised Statutes (HRS)
Resolution No. 439-06, Exhibit C List of Preemptions, Item 3.10 stated "except for building sites gaining access
from an alley, in which case the minimum yards shall be five (5) feet for the front yard facing the alley".
Resolution 416-07 amended the List of Preemption, and inadvertently removed the description of the building
sites gaining access from an alley.
The Housing Administrator request to amend Item 1.13 in Exhibit C List of Preemption, of Resolution 416-07 to
include the language for building sites gaining access from an alley to have the five (5) feet minimum yard.
The draft resolution was reviewed and approved by the Planning Director as well as Corporation Counsel.

RE: Resolution No. 353-14 : A RESOLUTION AUTHORIZING THE AMENDMENT OF
CERTAIN ZONING CODE REQUIREMENTS FOR KAMAKOA NUI, THE WAIKOLOA
EMPLOYEE HOUSING PROJECT, PURSUANT TO CHAPTER 46-15 OF THE HAWAI`I
REVISED STATUTES.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Planning to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval be granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Planning for placement on its future agenda.
