Ms. Virginia Goldstein Planning Director Planning Department Countv of Hawaii 25 Aupuni Street ' Hilo, Hawaii 96720 RE: Annual Report Zoning Ordinance 90-160, as amended by Zoning Ordinance No. 95-51 Highlands Golf Estates TMK: 6-8-02:Portion 16 and 6-8-03:Portion 32 Dear Ms. Goldstein: Please let this letter serve as the ninth annual report required by Condition G of the above- referenced Zoning Ordinance, as amended, for the Highlands Golf Estates project. Compliance with conditions of approval is an ongoing process. In addition the following specific actions of compliance have been undertaken: 1. The subdivision improvements and drainage plans required by Conditions B and E were approved by the State Department of Health, the County Departments of Public \i,'nsl~ ~r r1 ~7Vo4ar C~innl~, and \l,7ailrnl!i~ \7llaFp~ ~'nm++gnV T; Nn~'?rilber 1993. The - rr•~ e - subdivision improvement plans were forwarded to the Planning Department in November 1993. Approval of the plans by the Planning Department is pending its review of the final subdivision plat map, which was submitted on June 10, 1996. 2. Channelization improvements to the Waikoloa Road/Paniolo Avenue/Pua Melia Street intersection, as required by Conditions B and C, were completed in September 1996 and accepted by the County on September 17, 1996. 3. Condition D, regarding affordable housing, has been satisfied, per the Office of the Corporation Counsel determination, as set forth in its June 3, 19941etter to the Office of Housing and Community Development, with a copy to the Chairman of the County Housing Agency, that no such requirement exists for this project. In addition to requiring the channelization improvements referred to in #2 above, Condition B also requires that the developer secure final subdivision approval for not less than 175 lots within five years of the effective date of Ordinance No. 95-51, or by March 21, 2000. While interest in beach resort property has increased over the last few years, no such interest is being expressed in projects such as the planned Highlands Golf Course and Golf Estates project, making the development of this project at this time economically unfeasible. Because of this, we will be submitting a request for an extension of time to comply with the portion of Condition B requiring obtainment of final subdivision approval.
